STATUTORY RULES AND ORDERS. 1940. No. 363.

SAVINGS CERTIFICATES (FEES ON DETERMINATION OF DISPUTES) ORDER, 1940.

WHEREAS it is enacted by paragraph (f) of subsection (3) of section 30 of the Finance Act, 1940 (No. 14 of 1940), that the Minister for Finance may by order, if he so thinks fit, direct that there shall be charged by the Registrar of Friendly Societies a fee or fees in respect of every dispute mentioned in the said subsection (3) heard and determined by him, and the said Minister may by any such order prescribe the amount of such fees, the persons by whom such fees shall be paid, and the manner in which such fees shall be collected and paid :

NOW, the Minister for Finance, in exercise of the powers conferred on him by section 30 of the Finance Act, 1940 , (No. 14 of 1940), and of every and any other power him in this behalf enabling hereby orders as follows :—

1. This Order may be cited as the Savings Certificates (Fees on Determination of Disputes) Order, 1940.

2. In this Order the expression " the Registrar " means the Registrar of Friendly Societies.

3. A fee or fees in accordance with the Schedule to this Order shall be charged by the Registrar in respect of every dispute heard and determined by him arising between the Minister for Posts and Telegraphs and the holder of, or a person claiming to be entitled to, a Savings Certificate as to the ownership of such Certificate or the amount repayable in respect thereof.

4. Every fee charged in pursuance of this Order shall be paid by such party or parties to the dispute as the Registrar shall determine and shall be paid to the Registrar in money or, if he so directs, be deducted from the proceeds of the relevant Savings Certificate or Certificates.

  " 150,a fee of £2 together with, where the number of the certificates exceeds 200, £1 for every 100 or part of 100 certificates in excess of 200.

In the foregoing table the word " certificates " refers to single certificates and, accordingly, in applying it in the case of multiple certificates regard shall be had to the number of single certificates represented by the multiple certificates.

2. Where the dispute is heard elsewhere than in Dublin, there shall be charged, in addition to the fee appropriate under the first paragraph of this Schedule, a fee consisting of a sum calculated at the rate of £3 3s. od. for each day or part of a day during which the hearing continues together with a sum equal to the travelling expenses and subsistence allowances of the Registrar.
