ELECTORAL ACT (ALTERATION OF REGISTRATION RULES ORDER, 1940.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

THE ELECTORAL ACT, 1923 .

WHEREAS in pursuance of subsection (2) of Section 11 of the Electoral Act, 1923 (hereinafter referred to as " the Act "), as adapted by subsequent enactments, the Minister for Local Government and Public Health (hereinafter referred to as " the Minister ") did by order under his official seal, bearing date the 13th day of October, 1933, entitled the Electoral Act (Alteration of Registration Rules) Order, 1933, alter the rules contained in the First Schedule to the Act by adding to Rule 7 thereof a new paragraph (g) making provision for the performance of the duties of a collector of poor rate under the said Rule 7 during a period when such office is vacant :

AND WHEREAS it is necessary for the purpose of carrying the Act into effect that provision be made for the performance of the said duties of a collector of poor rate when the person holding such office is suspended from the performance of his duties :

NOW, THEREFORE, the Minister, in exercise of the powers conferred on him by the said sub-section (2) of section 11 of the Act, and in exercise of every other power enabling him in this behalf, hereby orders as follows, that is to say :—

1. This Order may be referred to as " the Electoral Act (Alteration of Registration Rules) Order, 1940."

2. The Interpretation Act, 1937 , applies to the interpretation of this Order.

3. Rule 7 of the First Schedule to the Act, as altered by the above-recited Order, the Electoral Act (Alteration of Registration Rules) Order, 1933, shall be and is hereby altered by the insertion at the end of the said Rule, as so altered, of the following paragraph, that is to say :—

(h) For the purposes of the foregoing paragraph (g) of this Rule, the office of a collector of poor rate shall be deemed to be vacant if the person holding such office is for the time being suspended from the performance of his duties and the provisions of that paragraph shall apply accordingly in such case with the necessary modifications.
