STATUTORY RULES AND ORDERS. 1940. No. 268.

ACQUISITION OF DERELICT SITES REGULATIONS, 1940.

The Minister for Local Government and Public Health in exercise of the power conferred on him by section 1, sub-section (1) of section 6 and section 12 of the Acquisition of Derelict Sites Act, 1940 , hereby makes the following regulations that is to say :—

1. These regulations may be cited as the Acquisition of Derelict Sites Regulations, 1940.

2. Every vesting order made by a sanitary authority under the Acquisition of Derelict Sites Act, 1940 , shall be in the form set forth in the schedule to these regulations.

SCHEDULE.

FORM OF VESTING ORDER.

THE ACQUISITION OF DERELICT SITES ACT, 1940 .

WHEREAS

1. The plot of land described in the schedule to this order (in this order referred to as " the site ") is a derelict site within the meaning of the Acquisition of Derelict Sites Act, 1940 (in this order referred to as " the Act ") and is situate in the sanitary district consisting of the..........................................district of.........................................

2. The...................................(in this order referred to as " the sanitary authority ") is the sanitary authority of the said sanitary district.

Note 1.

3. The sanitary authority did propose to acquire under the Act the site (together with other land) and did make a preliminary order under section 3 of the Act in relation to the site (and such other land) and did comply with the provisions of sub-section (3) of the said section 3.

Note 2.

4. (Alternative I) :

No application has been made under and in accordance with section 4 of the Act for the annulment of the said preliminary order.

(Alternative II) :

made under and in accordance with section 4 of the Act for the annulment of the said preliminary order and on the final determination thereof the said preliminary order was not annulled.

(Alternative III) :

/images/v25p003b.jpg made under and in accordance with section 4 of the Act for the annulment of the said preliminary order and on the final determination thereof the said preliminary order was not annulled but the application of the said preliminary order was restricted to the site.

Note 3.

Now, therefore, the sanitary authority in exercise of the power conferred on them by section 5 of the Act hereby order that the site shall be vested in the sanitary authority on the.........day of....................................19........in fee-simple free from incumbrances and all estates, rights, titles and interests of whatsoever kind.

NOTES ON FORM.

Note 1—The portions in brackets need only be inserted where the application of the preliminary order has been restricted on appeal to a part (which part is now referred to as " the site ") of the land to which the preliminary order originally applied. In this case Alternative III should be adopted for Recital 4.

Note 2—Whichever alternative is appropriate should be adopted.

Note 3—The vesting date must not be earlier than seven days after the making of the order.

Note 4—The execution should be attested in whatever manner orders of the sanitary authority are attested.

Note 5—The site should be carefully and accurately described. If necessary a map or plan should be included.
