STATUTORY RULES AND ORDERS. 1940. No. 247.

CREAMERY BUTTER (MINIMUM PRICES) (No. 2) ORDER, 1940.

WHEREAS it is enacted by sub-section (2) of Section 39 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935) that the Minister for Agriculture may from time to time by order fix the price which shall, as on and from a specified date, be the minimum price under the said section in respect of butter of any specified class (defined in such manner as the said Minister shall think proper) and may by any such order fix a minimum price varying in accordance with all or any of the following things, that is to say :—

(a) the quantity of butter included in such sale or in any one delivery in pursuance of such sale, or

(b) the area in which the butter is delivered to the purchaser or to which the butter is forwarded for the purchaser, or

(c) the method of packing such butter.

AND WHEREAS it is enacted by sub-section (4) of Section 39 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935) that the Minister for Agriculture may at any time by order revoke or amend any order previously made by him under this section including an order made under this sub-section.

NOW I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935) and of every and any other power me in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the Creamery Butter (Minimum Prices) (No. 2) Order, 1940.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. The Creamery Butter (Minimum Prices) Order, 1940 (Statutory Rules and Orders No. 93 of 1940) as amended by the Creamery Butter (Minimum Prices) (Amendment) Order, 1940 (Statutory Rules and Orders No. 124 of 1940) and the Creamery Butter (Minimum Prices) (Amendment) (No. 2) Order, 1940 (Statutory Rules and Orders No. 213 of 1940) is revoked as on and from the 1st day of August, 1940.

4. The following prices shall be the minimum prices applicable to any particular class of creamery butter, that is to say :

(a) creamery butter which is delivered on sale to the Butter Marketing Committee, the price of seven pounds, fourteen shillings the hundredweight ;

(b) creamery butter which is sold by the manufacturer thereof to any person and is placed in cold storage by such person under and in accordance with an arrangement sanctioned by the Minister for Agriculture on or before the 2nd day of November, 1940, the price of seven pounds, five shillings and sixpence the hundredweight ;

(c) creamery butter (other than creamery butter to which the foregoing paragraphs (a) and (b) apply)

(i) if such butter is comprised in a consignment of not less than thirty hundredweights, the price of seven pounds, fourteen shillings the hundredweight ;

(ii) if such butter is comprised in a consignment of less than thirty hundredweights, the price of seven pounds, nineteen shillings the hundredweight.

5. This Order shall come into operation as on and from the 1st day of August, 1940.
