STATUTORY RULES AND ORDERS. 1940. No. 214.

CONTROL OF IMPORTS (REGULATIONS) (AMENDMENT) ORDER, 1940.

WHEREAS it is enacted by subsection (3) of section 2 of the Control of Imports Act, 1934 (No. 12 of 1934), that, for the purposes of that Act, goods shall not be deemed to have been manufactured in a particular country unless the prescribed proportion of their value is derived from expenditure of a prescribed kind incurred in the said country in respect of materials produced or work done in that country:

AND WHEREAS it is enacted by section 13 of the said Act that the Minister for Industry and Commerce may by order make regulations prescribing any matter or thing which is referred to in that Act as prescribed or to be prescribed:

AND WHEREAS by the Control of Imports (Amendment) Act, 1937 (No. 8 of 1937), the said Control of Imports Act, 1934 , was amended in certain respects:

NOW, the Minister for Industry and Commerce, in exercise of the powers conferred on him by section 13 of the Control of Imports Act, 1934 (No. 12 of 1934), and of every and any other power him in this behalf enabling, hereby orders as follows:—

1. This Order may be cited as the Control of Imports (Regulations) (Amendment) Order, 1940.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order and the regulation made thereunder.

3. In this Order the expression "the Principal Order" means the Control of Imports (Regulations) Order, 1937 (Statutory Rules and Orders, No. 197 of 1937).

4. Notwithstanding anything contained in regulation I of Article 5 of the Principal Order, the following regulation shall apply and have effect in relation to the descriptions of goods specified in the Schedule to this Order, that is to say:—

For the purposes of the Control of Imports Acts, 1934 and 1937, goods of any of the descriptions specified in the Schedule to this Order shall not be deemed to have been manufactured in a particular country unless a proportion equal to at least fifty per cent. of their value is derived from expenditure incurred in that country in respect either of materials produced in that country which form part of such goods or of work done in that country in relation to such goods or of both such materials and such work.

SCHEDULE.

Woven piece goods the importation of which is prohibited by any of the following orders, that is to say:—

(a) Control of Imports (Quota No. 39) Order, 1940;

(b) Control of Imports (Quota No. 40) Order, 1940;

(c) Control of Imports (Quota No. 41) Order, 1940;

(d) Control of Imports (Quota No. 42) Order, 1940.
