STATUTORY RULES AND ORDERS. 1940. No. 179.

AIR-RAID PRECAUTIONS (ESSENTIAL UNDERTAKER'S) SCHEMES (PRESCRIBED PROVISIONS) REGULATIONS, 1940.

WHEREAS it is enacted by sub-section (2) of section 37 of the Air-Raid Precautions Act, 1939 (No. 21 of 1939), that air-raid precautions (essential undertaker's) schemes shall in particular contain provisions in respect of such matters as may be prescribed by regulations made by the Minister for Defence under Part III of that Act but the said Minister may, as regards any particular essential undertaker, exempt such essential undertaker from the duty to include in such scheme any matter so prescribed, and thereupon such essential undertaker shall not be required to include provisions in respect of that matter :

AND WHEREAS it is enacted by section 48 of the said Act that the Minister for Defence may, with the concurrence of the Minister for Finance, make regulations in relation to (amongst other things) any matter or thing referred to in Part III of the said Act as prescribed or to be prescribed by regulations made by the Minister for Defence under that Part of that Act :

NOW, THEREFORE, I, SEÁN MOYLAN, Parliamentary Secretary to the Minister for Defence, in exercise of the powers conferred on the Minister for Defence by section 48 of the Air-Raid Precautions Act, 1939 (No. 21 of 1939), and delegated to me under section 6 of the Emergency Powers Act, 1939 (No. 28 of 1939), and of every and any other power me in this behalf enabling, do hereby with the concurrence of the Minister for Finance testified by his signature hereto, make the following regulations :—

1. These Regulations may be cited as the Air-Raid Precautions (Essential Undertaker's) Schemes (Prescribed Provisions) Regulations, 1940.

2. In these Regulations, the expression " the Act " means the Air-Raid Precautions Act, 1939 (No. 21 of 1939).

3. Every air-raid precautions (essential undertaker's) scheme submitted under section 37 of the act by an essential undertaker shall, subject to any exemption to such essential undertaker under sub-section (2) of the said section 37, contain provisions in respect of all the following matters, that is to say :—

(a) the designation of the persons responsible for emergency arrangements and of the organisation required for the various air-raid precautions services ;

(b) the co-ordination of the scheme with that of the local authority, in whose functional area the undertaking of such essential undertaker is situate, and other outside schemes ;

(c) instruction in air-raid precautions of (i) the workers generally (ii) key-men and (iii) the personnel of air-raid precautions services, including specific directions as to the action to be taken by each member of the staff in the event of an air-raid ;

(d) the provision of air-raid shelter for staff ;

(e) the supply of service respirators and other forms of individual protection to key-men and personnel of air-raid precautions services ;

(f) the special protection of key-men who must remain on duty during an air-raid ;

(g) the protection of vital places and vital parts of works, which, if damaged, would interfere with supplies, and arrangements for alternative methods of functioning in the event of damage ;

(h) arrangements for the accumulation of reserve stocks of important spare parts and other essential requirements ;

(i) the organisation and equipment of emergency repair squads ;

(j) arrangements for protection of goods and stores from contamination by gas ;

(k) the training and equipping of personnel and provision of a depôt for a squad or squads for decontamination work ;

(l) the organisation for examination of ships (if any), goods, articles and vehicles, used in connection with the undertaking, which are suspected of contamination and for dealing with same ;

(m) the establishing and equipping of first-aid post or posts, first-aid party or parties and training personnel therefor ;

(n) the organising, equipping and training of rescue and demolition parties ;

(o) the organising, equipping and training of firefighting parties ;

(p) the augmenting of existing firefighting appliances, including, in particular, the supplying of equipment for dealing with incendiary bombs ;

(q) the special protection of inflammable materials and buildings containing inflammable materials against the effects of incendiary bombs ;

(r) arrangements as to water supply for firefighting ;

(s) arrangements for the communication of air-raid warnings and " all-clear " signals to employees and other persons on the premises and to ships in a dock area ;

(t) arrangements for emergency communications to be maintained within and without the undertaking in the event of the telephone system breaking down ;

(u) arrangements for or in connection with the restriction and control of lighting.

4. Every air-raid precautions (essential undertaker's) scheme submitted under section 37 of the act shall, as regards each matter, provision in respect of which is, in pursuance of the immediately preceding Regulation, contained in such scheme, specify the actions proposed to be taken—

(a) as soon as may be after the approval of such scheme by the Minister under the Act,

(b) as opportunity from time to time affords, and

(c) when attack from the air appears imminent.
