STATUTORY RULES AND ORDERS. 1940. No. 125.

DUBLIN DISTRICT MILK BOARD (MINIMUM PRICES FOR MILK) ORDER, 1940.

WHEREAS a determination of the Dublin District Milk Board under section 42 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), was communicated to the Minister for Agriculture and has been considered by him :

NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by clause (i) of paragraph (b) of subsection (i) of section 43 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), and of every and any other power me in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the Dublin District Milk Board (Minimum Prices for Milk) Order, 1940, and shall come into operation on the 1st day of May, 1940.

2. In this Order—

the expression " registered producers " means persons registered in the register of producers kept by the Dublin District Milk Board ;

the expression " registered retailers " means persons registered in the register of retailers kept by the Dublin District Milk Board ;

the expression " registered wholesalers " means persons registered in the register of wholesalers kept by the Dublin District Milk Board ;

the expression " collecting place " means a place other than the producer's registered premises at which milk is delivered by mutual agreement between the producer and the purchaser.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. The Dublin District Milk Board (Minimum Prices for Milk) Order, 1939 (No. 91 of 1939), is hereby revoked.

5. The minimum prices to be paid to registered producers for milk sold by them to registered retailers shall be at the following rates :—

(a) if the milk is delivered at registered premises of the purchaser, one shilling and one farthing per gallon ;

(b) if the milk is delivered, in the case of a registered retailer carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered retailer, at the railway station nearest to such retailer's registered premises, one shilling per gallon ;

(c) if the milk is delivered at the registered premises of the producer or at the collecting place,

(i) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, eleven pence farthing per gallon ;

(ii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles but does not exceed twenty miles, eleven pence per gallon ;

(iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds twenty miles but does not exceed thirty miles, ten pence three farthings per gallon ;

(iv) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles but does not exceed forty miles, ten pence halfpenny per gallon ;

(v) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, ten pence farthing per gallon.

6. The minimum prices to be paid to registered producers for milk sold by them to registered wholesalers shall be at the following rates :—

(a) if the milk is delivered at registered premises of the purchaser, ten pence three farthings per gallon ;

(b) if the milk is delivered, in the case of a registered wholesaler carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered wholesaler, at the railway station nearest to such wholesaler's registered premises, ten pence halfpenny per gallon ;

(c) if the milk is delivered at the registered premises of the producer or at the collecting place,

(i) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, nine pence three farthings per gallon ;

(ii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles but does not exceed twenty miles, nine pence halfpenny per gallon ;

(iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds twenty miles but does not exceed thirty miles, nine pence farthing per gallon ;

(iv) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles but does not exceed forty miles, nine pence per gallon ;

(v) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, eight pence three farthings per gallon.
