STATUTORY RULES AND ORDERS. 1940. No. 81.

INDUSTRIAL ASSURANCE (FEES FOR DETERMINATION OF DISPUTES) REGULATIONS, 1940.

WHEREAS it is enacted by subsection (10) of section 72 of the Insurance Act, 1936 (No. 45 of 1936), that whenever any such dispute as is mentioned in subsection (1) of the said section 72 is referred to the Minister for Industry and Commerce for determination under the said section 72, there shall be paid to the Minister such fee as shall be prescribed by regulations made by the said Minister under the said section 72 with the consent of the Minister for Finance:

NOW, the Minister for Industry and Commerce, in exercise of the powers conferred on him by section 72 of the Insurance Act, 1936 (No. 45 of 1936), and of every and any other power him in this behalf enabling, with the consent of the Minister for Finance, hereby makes the following regulations:—

1. These Regulations may be cited as the Industrial Assurance (Fees for Determination of Disputes) Regulations, 1940.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. On every reference under section 72 of the Insurance Act, 1936 (No. 45 of 1936), to the Minister for Industry and Commerce of a dispute for determination by the said Minister of such dispute there shall be paid to the said Minister whichever of the following fees is applicable to the particular case, that is to say:—

(a) where the amount of the claim in dispute does not exceed ten pounds, a fee of two shillings and sixpence;

(b) where the amount of the claim in dispute exceeds ten pounds and does not exceed twenty-five pounds, a fee of five shillings;

(c) where the amount of the claim in dispute exceeds twenty-five pounds but does not exceed fifty pounds, a fee of ten shillings;

(d) where the amount of the claim in dispute exceeds fifty pounds, a fee of ten shillings in respect of the first fifty pounds, together with a further fee of ten shillings for every additional fifty pounds or part of fifty pounds;

(c) where the dispute relates to the rights of the parties to the dispute without involving any pecuniary claim, a fee of ten shillings.
