BY-LAW No. 437 OYSTER FISHERIES

WATERFORD HARBOUR.

I, SÉAMAS Ó RIAIN, Minister for Agriculture, by virtue and in exercise of the powers vested in me by the Fisheries Act, 1925 , the Fisheries (Redistribution of Public Services) Order, 1934, and of every other power enabling me in this behalf DO MAKE AND ORDAIN THE FOLLOWING BY-LAW :—

(1) It shall not be lawful during the period from the 1st day of October, 1939, to the 30th day of September, 1941, both said days inclusive, to dredge for, take, catch or destroy any Oyster or Oyster Brood in any part of the public or natural oyster beds which are situated in that part of the common estuary of the Rivers Suir, Nore and Barrow between a line running from the Tower at Passage East to the extremity of the Quay at Ballyhack, and a line running from the most eastern point of Geneva Barracks to the leading lights at Duncannon ;

(2) Each and every person offending against this By-Law shall forfeit and pay for each offence a sum not exceeding Five Pounds, and any Oyster or Oyster Brood taken in contravention thereof shall be forfeited ;

(3) The Interpretation Act, 1937 (No. 38 of 1937) applies to this By-Law ;

(4) This By-Law may be cited for all purposes as the Waterford Harbour Oyster By-Law, No. 437, 1939.
