NATIONAL HEALTH INSURANCE (GREAT BRITAIN RECIPROCAL ARRANGEMENTS) ORDER, 1939.

THE NATIONAL HEALTH INSURANCE (GREAT BRITAIN RECIPROCAL ARRANGEMENTS) ORDER, 1939, DATED 28th DECEMBER, 1939, MADE BY THE MINISTER FOR LOCAL GOVERNMENT AND PUBLIC HEALTH.

The Minister for Local Government and Public Health in exercise of the powers now vested in him under Section 17 of the National Health Insurance Act, 1923 , as amended by Section 5 of the National Health Insurance and Widows' and Orphans' Pensions Act, 1936 , and of all other powers enabling him in that behalf hereby makes the following Order :—

1.—(1) This Order may be cited as the National Health Insurance (Great Britain Reciprocal Arrangements) Order, 1939.

(2) The Interpretation Act, 1889, applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas passed before the first day of January, 1924.

(3) This Order shall have effect as from the first day of January, 1940, but shall not come into force unless and until an Order has been made by the National Health Insurance Joint Committee in pursuance of the powers conferred on them by Section 67 of the National Health Insurance Act, 1936 , for the purpose of carrying out the Arrangements contained in the Schedule to this Order.

2. The provisions contained in the Arrangements set out in the Schedule to this Order shall have full force and effect so far as they relate to Éire, and the National Health Insurance Acts, 1911-1936, shall have effect in Éire, subject to such modifications as may be required in those Acts for the purpose of giving effect to the provisions contained in the said Arrangements.

SCHEDULE.

Arrangements made between the National Health Insurance Joint Committee and the Minister for Local Government and Public Health.

Memorandum of Arrangements which have been mutually agreed upon between the National Health Insurance Joint Committee acting under the powers conferred on them by Section 67 of the National Health Insurance Act, 1936 , and the Minister for Local Government and Public Health (acting under the powers now vested in him under Section 17 of the National Health Insurance Act, 1923 , as amendedby Section 5 of the National Health Insurance and Widows' and Orphans' Pensions Act, 1936 ).

1. The National Health Insurance Joint Committee and the Minister for Local Government and Public Health shall make such Orders as may be necessary to carry these Arrangements into effect and such Orders shall be made simultaneously on a date to be mutually agreed.

2. The following provisions shall be added after Article 17 of the Memorandum of Arrangements made between the National Health Insurance Joint Committee and the Irish Insurance Commissioners (whose functions are now vested in the Minister for Local Government and Public Health) dated the 16th February, 1924 (hereinafter referred to as " the principal Memorandum ") and set out in the Schedule to the National Health Insurance (Irish Free State Reciprocal Arrangements) Order, 1924, and the Schedule to the National Health Insurance (Great Britain Reciprocal Arrangements) Order, 1924, and the heading to Part IV of the principal Memorandum shall be modified accordingly:—

" 17A—(1) A person who is resident in one country and who is employed on a ship which is registered in, and the owner of which or, if there is more than one owner, the managing owner or manager, resides or has his principal place of business in, the other country, shall be treated as insured under the National Health Insurance Acts in force in the country in which the person is resident.

(2) Contributions paid in respect of the employment of a person to whom this Article applies shall be treated as if they had been paid under the National Health Insurance Acts in force in the country in which the person is resident.

(3) A person to whom this Article applies shall be treated as though his previous insurance under the National Health Insurance Acts in force in the other country had been insurance under the National Health Insurance Acts in force in the country in which he is resident."

3. Article 19 of the principal Memorandum shall have effect as though it included a power to make provision for transfer values in respect of persons to whom Article 2 of this Memorandum applies.

4. Except where the context otherwise requires, words and expressions in this Memorandum shall have the same meaning as in Section 67 of the National Health Insurance Act, 1936 , and in Section 17 of the National Health Insurance Act, 1923 , as amended by Section 5 of the National Health Insurance and Widows' and Orphans' Pensions Act, 1936 .

5. This Memorandum shall be read as one with the principal Memorandum and shall have effect as from the first day of January, 1940.
