STATUTORY RULES AND ORDERS. 1939. No. 400.

DAIRY PRODUCE ACT, 1924 (REGULATIONS UNDER PART III) (AMENDMENT) (No. 2) ORDER, 1939.

WHEREAS by virtue of sub-section (1) of section 27 of the Dairy Produce Act, 1924 (No. 58 of 1924), the Minister for Agriculture is empowered by order to make regulations in regard to (amongst other matters) the method and manner in all respects of packing butter, including the materials and packages to be used for such packing :

WHEREAS in exercise of the powers conferred by (amongst provisions of the said Act) the said sub-section (1), the Dairy Produce Act, 1924 (Regulations Under Part III) Order No. 1, 1925 (Statutory Rules and Orders, No. 51 of 1925), was made on the 6th day of October, 1925 :

AND WHEREAS the said Order has been amended, and it is expedient to amend it further in the manner hereinafter appearing :

NOW, THEREFORE, the Minister for Agriculture, in exercise of the powers conferred on him by sub-section (1) of section 27 of the Dairy Produce Act, 1924 (No. 58 of 1924), and of every and any other power him in this behalf enabling, hereby by this Order makes the following regulations, that is to say :—

1.—(1) This Order may be cited as the Dairy Produce Act, 1924 (Regulations Under Part III) (Amendment) (No. 2) Order, 1939.

(2) This Order shall come into operation on the 5th day of December, 1939.

2.—The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3.—(1) Regulation 4 of the Dairy Produce Act, 1924 (Regulations Under Part III) Order No. 1, 1925 (Statutory Rules and Orders, No. 51 of 1925), is hereby amended by the insertion in paragraph (1) of the said regulation of the following sub-paragraph, in lieu of sub-paragraph (d) now (by virtue of the Dairy Produce Act, 1924 (Regulations Under Part III) (Amendment) Order, 1936 (Statutory Rules and Orders, No. 169 of 1936)) contained in the said paragraph (1), that is to say :—

" (d) a standard package in which butter has been delivered on sale shall not be used again or the packing of butter, unless such package is clean and sound and has, prior to being so used again, been thoroughly steamed."

(2) The Dairy Produce Act, 1924 (Regulations Under Part III) (Amendment) Order, 1936 (Statutory Rules and Orders, No. 169 of 1936), is hereby revoked.

4.—This Order shall be included amongst the orders which may be cited as the Dairy Produce Act, 1924 (Regulations Under Part III) Orders, 1925 to 1939.
