AGRICULTURAL PRODUCE (EGGS) (AMENDMENT) REGULATIONS, 1939.

I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Agricultural Produce (Eggs) Act, 1939 (No. 2 of 1939), and of every and any other power me in this behalf enabling, do by this Order make the following regulations :—

1. In these Regulations, the expression " the Principal Regulations " means the Agricultural Produce (Eggs) Regulations, 1939 (Statutory Rules and Orders, No. 169 of 1939).

2. Article 16 of the Principal Regulations is hereby amended by the insertion before paragraph (6) thereof of a new paragraph as follows :—

" (5a) The following provisions shall have effect in respect of eggs which would be fresh eggs but for not being sound in shell (in this paragraph referred to as cracked eggs), that is to say:

(i) cracked eggs shall, before being despatched from registered wholesaler's premises, be marked with the word ` cracked ' in letters not less than one sixteenth of one inch high enclosed in a circle not less than one half inch in diameter in the manner indicated by the following pattern, thus :

(ii) cracked eggs shall not be consigned for export from registered wholesaler's premises."

3. Article 17 of the Principal Regulations is hereby amended by the deletion of paragraph (4) of the said Article and the substitution in lieu thereof of the following paragraph, that is to say :—

" (4) Standard cases used for the packing of eggs on registered wholesaler's premises shall be sound and clean. "

4. Article 23 of the Principal Regulations is hereby amended by the deletion of paragraph (1) of the said Article and the substitution in lieu thereof of the following paragraph, that is to say :—

" (1) Subject to the provisions of this Article, all eggs acquired from a producer by any retailer shall be marked with a mark (in this Article referred to as the retail code mark) to indicate the period during which such eggs were examined on the premises of such retailer and such mark shall be applied :—

(a) in the case of eggs sold or offered or exposed for sale by retail within a period of forty-eight hours from the acquisition thereof, before such sale, offer, or exposure, and

(b) in the case of all other eggs, within a period of forty-eight hours from the acquisition thereof. "

5. These Regulations may be cited as the Agricultural Produce (Eggs) (Amendment) Regulations, 1939.
