STATUTORY RULES AND ORDERS. 1939. No. 295.

CONTROL OF IMPORTS (QUOTA No. 37) (AMENDMENT) ORDER, 1939.

WHEREAS it is enacted by Section 11 of the Control of Imports Act, 1934 (No. 12 of 1934), as adapted in consequence of the enactment of the Constitution, that the Government may at any time by order amend any quota order previously made under the said Act :

AND WHEREAS by Section 2 of the Control of Imports (Amendment) Act, 1937 (No. 8 of 1937), as adapted as aforesaid, it is enacted that the Government may, in and by a quota order, do all or any of certain things :

AND WHEREAS on the 12th day of November, 1937, the Control of Imports (Quota No. 37) Order, 1937 (Statutory Rules and Orders, No. 288 of 1937), was made under Section 3 of the said Control of Imports Act, 1934 :

NOW, the Government, in exercise of the powers conferred on them by the Control of Imports Acts, 1934 and 1937, as adapted in consequence of the enactment of the Constitution, and of every and any other power them in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the Control of Imports (Quota No. 37) (Amendment) Order, 1939.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. Paragraph 4 of the Control of Imports (Quota No. 37) Order, 1937 (Statutory Rules and Orders, No. 288 of 1937), is hereby amended as follows, that is to say :—

(a) by deleting the word " which " where it occurs in subparagraph (a) of the said paragraph and inserting in lieu of the said word so deleted the words " made wholly or mainly of felt which are of a value, for the purposes of the Customs Acts, of less than twelve shillings and nine pence each and "; and

(b) by inserting the words " made wholly or mainly of felt " immediately before the word " which " where that word occurs in subparagraph (b) of the said paragraph.

4. Paragraph 5 of the Control of Imports (Quota No. 37) Order, 1937, is hereby amended as follows, that is to say :—

(a) by deleting subparagraph (c) of the said paragraph and inserting in lieu of the said subparagraph so deleted the following subparagraph, that is to say :—

" (c) articles—

(i) which are shown, to the satisfaction of the Revenue Commissioners, to be designed, constructed, and intended solely for use for scientific, medical, or surgical purposes, or

(ii) which are imported in such circumstances that the Revenue Commissioners are satisfied that such articles are being imported as a gift from a person outside Ireland to a person resident in Ireland, or

(iii) in respect of which it is shown to the satisfaction of the Revenue Commissioners that, having regard to the purposes for which they are imported, importation thereof without payment of any duty of customs could lawfully be permitted by virtue of Section 17 or paragraph (a) or paragraph (b) of Section 18 or Section 21 of the Finance Act, 1936 (No. 31 of 1936), or

(iv) which are shown to the satisfaction of the Revenue Commissioners to be imported solely for the purpose of any competition, exhibition, show, or demonstration or any similar purpose and are not intended to be sold or offered for sale in Ireland, or " ;and

(b) by adding after clause (iv) of subparagraph (d) of the said paragraph the following clauses, that is to say :—

" (v) for further manufacture and subsequent exportation, or

(vi) temporarily only " ; and

(c) by deleting subparagraph (e) of the said paragraph.

5. This Order shall come into operation on the 1st day of October, 1939.
