STATUTORY RULES AND ORDERS. 1939. No. 184.

MINISTER FOR FINANCE (AGENCY) ORDER, 1939.

WHEREAS it is enacted by Section 11 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924), as adapted in consequence of the enactment of the Constitution, that it shall be lawful for any Minister pursuant to any arrangement or agreement previously authorised by an order of the Government to exercise or perform any of the duties or public services of any other Minister as agent for such other Minister and without relieving such other Minister of his responsibility for the administration of such public service:

AND WHEREAS, Seán MacEntee, Minister for Finance, anticipating that in the months of July and August, 1939, he will be absent from his official duties as Minister for Finance, has arranged and agreed with the Taoiseach that the Taoiseach shall during such absence exercise and perform the duties and public services assigned to him, the said Seán MacEntee as such Minister, as agent for him the said Minister, and without relieving him of his responsibility for the administration of such public services:

AND WHEREAS it is expedient that the carrying of the said arrangement and agreement into effect should be authorised by the Government:

NOW, the Government, in exercise of the powers in this behalf vested in them by the said Section 11 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924), as adapted in consequence of the enactment of the Constitution, and of every and any other power them in this behalf enabling, do hereby order as follows:—

1. The Taoiseach is hereby authorised to exercise and perform as agent for the Minister for Finance, pursuant to the arrangement and agreement aforesaid, any of the duties and public services of the Minister for Finance during such time or times in the months of July and August, 1939, as the said Seán MacEntee may be absent from his official duties as Minister for Finance.

2. The exercise and performance of the public services aforesaid by the Taoiseach as such agent pursuant to the said arrangement and agreement shall not relieve the Minister for Finance of his responsibility for the administration of those public services.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. This Order may be cited for all purposes as the Minister for Finance (Agency) Order, 1939.
