STATUTORY RULES AND ORDERS. 1939. No. 181.

DISTRICT COURT (FEES) ORDER, 1939.

WHEREAS it is enacted by sub-section (1) of Section 65 of the Courts of Justice Act, 1936 (No. 48 of 1936), that it shall be lawful for the Minister for Justice, by order made with the consent of the Minister for Finance, to prescribe and from time to time as occasion requires vary or otherwise revise the fees to be charged in the several offices established by the Court Officers Act, 1926 (No. 27 of 1926), as amended by subsequent enactments (including the said Courts of Justice Act, 1936 ), and the persons by whom and the occasions on which such fees are to be paid and the officers by whom and the manner in which such fees are to be collected :

AND WHEREAS the District Court (Fees) Order, 1937 (Statutory Rules and Orders, No. 177 of 1937), was made by the Minister for Justice under the said sub-section (I) :

NOW, I, PATRICK J. RUTTLEDGE, Minister for Justice, in exercise of the powers conferred on me by sub-section (1) of Section 65 of the Courts of Justice Act, 1936 (No. 48 of 1936), and of every and any other power me in this behalf enabling, do, with the consent of the Minister for Finance testified by his official seal affixed hereto, hereby order as follows :—

1.—(1) This Order may be cited as the District Court (Fees) Order, 1939.

(2) The Principal Order and this Order may be cited together as the District Court (Fees) Orders, 1937 and 1939.

2. This Order shall come into operation on the 1st day of August, 1939.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. In this Order—

the expression " the Principal Order " means the District Court (Fees) Order, 1937 (Statutory Rules and Orders, No. 177 of 1937).

5. The amount of the fee mentioned at Item 3 in Section III of the Schedule of Fees in the Principal Order (being the fee on the issue of a certificate of renewal of a licence) shall, in lieu of the amount mentioned in the second column at the said Item 3, be whichever of the following amounts is applicable that is to say :—

(a) where the premises to which the licence relates are situate in the Dublin Metropolitan Area—twelve shillings and sixpence ;

(b) in all other cases—two shillings and sixpence.
