STATUTORY RULES AND ORDERS. 1939. No. 117.

CREAMERY BUTTER (BOUNTY) ORDER, 1939.

WHEREAS it is enacted by sub-section (1) of section 34 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), that the Minister for Agriculture may from time to time by Order make regulations prescribing the rates of bounty under Part VII of the said Act on creamery butter, and may at any time revoke any such order :

AND WHEREAS it is enacted by sub-section (2) of the said section that the said Minister may by regulations made under the said section prescribe different rates of bounty on different classes (defined in such manner as the said Minister shall think proper) of the same substance and may prescribe the date on which any particular rate of bounty shall come into force :

AND WHEREAS it is enacted by section 49 of the said Act that every reference in the said Act to the definition by the said Minister of different classes of a substance shall be construed as including classification by reference to exportation, sale, marketing, importation or other dealing by a central marketing organisation operating under rules approved by the said Minister :

AND WHEREAS the Butter Marketing Committee is a central marketing organisation within the meaning of the said section 49, and is operating under rules approved by the said Minister :

NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by sections 34 and 49 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), and of every and any other power me in this behalf enabling, do by this Order make the following regulations :—

1. This Order may be cited as the Creamery Butter (Bounty) Order, 1939.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. The Creamery Butter (Bounty) (No. 2) Order, 1938 (Statutory Rules and Orders, No. 288 of 1938), the Creamery Butter (Bounty) (Amending) Order, 1939 (Statutory Rules and Orders, No. 24 of 1939), and the Creamery Butter (Bounty) (Amending) (No. 2) Order, 1939 (Statutory Rules and Orders, No. 62 of 1939), are hereby revoked as on and from the 1st day of April, 1939.

4.—(1) The rate of bounty on creamery butter shall be whichever of the following rates is applicable to any particular class of creamery butter, that is to say :—

(a) on creamery butter which is delivered on sale in the State and on which a levy at the appropriate rate has been paid, and which is exported on or after the 1st day of April, 1939, Eighteen Shillings and Sixpence the hundredweight ;

(b) on creamery butter which is approved butter within the meaning of the rules relating to the marketing of butter made on the 16th day of April, 1937, and approved of by the Minister for Agriculture under section 49 of the Dairy Produce (Price Stabilisation) Act, 1935 , and which is exported on or after the 1st day of April, 1939, Seven Shillings and Sixpence the hundredweight ; and

(c) on creamery butter which is not approved butter within the meaning of the said rules and which is exported on or after the 1st day of April, 1939, Four Shillings and Sixpence the hundredweight.

(2) The rates of bounty mentioned in and prescribed by this paragraph shall come into force as on and from the 1st day of April, 1939.
