STATUTORY RULES AND ORDERS. 1939. No. 62.

CREAMERY BUTTER (BOUNTY) (AMENDING) (No. 2) ORDER, 1939.

WHEREAS it is enacted by Section 34 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), that the Minister for Agriculture may from time to time by Order make regulations prescribing the rates of bounty under Part VII of the said Act on creamery butter and may at any time revoke or amend any such Order and may by any such Order prescribe the date on which any particular rate of bounty shall come into force :

AND WHEREAS the said Minister in exercise of the power conferred on him by the said Section 34 made the Creamery Butter (Bounty) (No. 2) Order, 1938 (Statutory Rules and Orders, No. 288 of 1938) :

AND WHEREAS it is enacted by Section 11 of the Dairy Produce (Price Stabilisation) (Amendment) Act, 1938 (No. 30 of 1938), that whenever the Minister for Agriculture makes an Order under sub-section (1) of Section 34 of the Dairy Produce (Price Stabilisation) Act, 1935 , amending an Order prescribing rates of bounty, the said Minister may, by the amending Order, prescribe a date, earlier than the date of the making thereof, as the date on which the amended rates of bounty are to come into force :

NOW, I, SÉAMAS Ó RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Dairy Produce (Price Stabilisation) Acts, 1935 and 1938, and of every and any other power me in this behalf enabling, do by this Order make the following regulations :—

1. This Order may be cited as the Creamery Butter (Bounty) (Amending) (No. 2) Order, 1939.

2.—(1) Paragraph (1) of Article 4 of the Creamery Butter (Bounty) (No. 2) Order, 1938 (Statutory Rules and Orders, No. 288 of 1938) as amended by the Creamery Butter (Bounty) (Amending) Order, 1939 (Statutory Rules and Orders, No. 24 of 1939) is hereby amended by the deletion of clauses (a), (b) and (c) of the said paragraph and the substitution therefor of the following new clauses—

(a) on creamery butter which is delivered on sale in Eire and on which a levy at the appropriate rate has been paid, if exported on or after the 1st day of December, 1938, six shillings the hundredweight, and

(b) on creamery butter which is approved butter within the meaning of the rules relating to the marketing of butter made on the 16th day of April, 1937, and approved of by the Minister for Agriculture under Section 49 of the Dairy Produce (Price Stabilisation) Act, 1935 , if exported on or after the 1st day of December, 1938, one penny the hundredweight, and

(c) on creamery butter which is not approved butter within the meaning of the said rules, if exported on or after the 31st day of December, 1938, one penny the hundredweight.

(2) The rates of bounty mentioned in and prescribed by this paragraph shall come into force as on and from the 1st day of December, 1938.
