MILK AND DAIRIES (SPECIAL DESIGNATIONS) (AMENDMENT) REGULATIONS, 1939.

The Minister for Local Government and Public Health in exercise of the powers conferred on him by sections 31 and 35 of the Milk and Dairies Act, 1935 , with the concurrence of the Minister for Agriculture and in exercise of the further power conferred on him by section 15 of the said Act, hereby makes the following regulations, that is to say :—

1. These regulations may be cited as the Milk and Dairies (Special Designations) (Amendment) Regulations, 1939.

2. In these regulations the expression " the Principal Regulations " means the Milk and Dairies (Special Designations) Regulations, 1938.

3. These regulations and the Principal Regulations shall be construed as one and may be together cited as the Milk and Dairies (Special Designations) Regulations, 1938 and 1939.

4. In Part I of the second schedule to the Principal Regulations the following new paragraph shall be substituted for paragraph (2) of condition 24, that is to say :—

" (2) The milk which the holder of the licence is entitled to sell under the special designation Highest Grade Milk shall be so produced and treated that :—

(a) every sample of such milk taken for the purposes of this condition shall be found to contain not less than 3·1 per cent of milk-fat, and

(b) the average content of milk-fat of all samples of such milk taken for the purposes of this condition during any continuous period of six months shall be found to be not less than 3·25 per cent."

5. In Part II of the second schedule to the Principal Regulations the following new paragraph shall be substituted for paragraph (2) of condition 19, that is to say :—

" (2) The milk which the holder of the licence is entitled to sell under the special designation Standard Milk shall be so produced and treated that :—

(a) every sample of such milk taken for the purposes of this condition shall be found to contain not less than 3·1 per cent. of milk-fat, and

(b) the average content of milk-fat of all samples of such milk taken for the purposes of this condition during any continuous period of six months shall be found to be not less than 3.25 per cent."

6.—(1) Condition 21 of Part I of the second schedule to the Principal Regulations shall be amended by the deletion from the said condition of paragraphs (3) and (4).

(2) Condition 16 in Part II of the second schedule to the Principal Regulations shall be amended by the deletion from the said condition of paragraphs (3) and (4).

(3) Condition 9 in Part III of the second schedule to the Principal Regulations shall be amended by the deletion of the words " and no other words " from paragraph (2) of the said condition.

7. Any sampling bottle or closed receptacle containing a sample of milk taken for the purpose of any condition in the second schedule to the Principal Regulations shall be marked with a label in such form as the Minister shall from time to time direct and every condition in the said schedule relating to the taking of samples of milk shall be modified accordingly.
