STATISTICS (SALMON, SEA-TROUT AND EELS) ORDER, 1939.

THE STATISTICS (SALMON, SEA-TROUT AND EELS) ORDER, 1939, MADE BY THE MINISTER FOR AGRICULTURE UNDER SUB-SECTION (1) OF SECTION 16 of THE STATISTICS ACT, 1926 .

WHEREAS by the Statistics (Sea and Inland Fisheries) Transfer Order, 1927 (Statutory Rules and Orders, No. 25 of 1927), the powers and duties conferred by the Statistics Act, 1926 (No. 12 of 1926), on the Minister for Industry and Commerce in relation to sea and inland fisheries (but not including powers or duties relating to the export, import and internal transport of fish, the manufacture of fishery products, or the fish curing trade) have been transferred to the Minister for Fisheries :

AND WHEREAS it is provided by sub-section (1) of Section 16 of the Statistics Act, 1926 , that the Minister for Industry and Commerce may by Order do all or any of the following things, that is to say :—

(a) Prescribe the subject-matter, nature, character and periodicity of the statistics to be collected under this Act, and the time at or the occasion on which the same are to be collected ;

(b) Prescribe, subject to the provisions of this section, the persons or classes of persons by whom returns are to be made or information is to be given for the purpose of any statistics collected under this Act ;

(c) Make regulations for the collection, compilation, abstraction or publication of statistics generally or any particular class or classes of statistics under this Act ;

(d) Prescribe the schedules, forms, instructions and other documents to be used in the collection, compilation, abstraction or publication of statistics generally or of any particular class or classes of statistics under this Act ;

(e) Prescribe any matter or thing which is referred to in this Act as prescribed or to be prescribed by regulations made under this Act.

AND WHEREAS by sub-section (1) of Section 3 of the Ministers and Secretaries (Amendment) Act, 1928 (No. 6 of 1928), it is enacted that the Department of Fisheries shall be known as the Department of Lands and Fisheries, and the Minister who is head of that Department shall be styled the Minister for Lands and Fisheries :

AND WHEREAS by the Fisheries (Redistribution of Public Services) Order, 1934 (Statutory Rules and Orders, No. 40 of 1934), the powers and duties of the Minister for Lands and Fisheries in respect of the matters therein enumerated have been transferred to the Minister for Agriculture.

NOW, I, SÉAMAS O RIAIN, the Minister for Agriculture, in pursuance of the powers conferred on me by sub-section (1) of Section 16 of the Statistics Act, 1926 , and all other powers enabling me in that behalf, do hereby order :

1. Statistics shall be collected of the following subject matter, nature and character, that is to say, the number, weight and value of salmon, sea-trout and eels captured in Éire in the year 1939, together with particulars of the means of capture.

2. The following are the persons or classes of persons by whom returns are to be made or information is to be given for the purpose of the said statistics, that is to say :—

(a) All persons to whom licences are issued to capture salmon, sea-trout or eels ; and

(b) if the Minister so requires, the owners, lessees or occupiers of fisheries in which such fish are captured ; provided that in the case of such owners, lessees and occupiers the returns and information required shall be limited to such as is within their power to make and give.

3. The said statistics shall be collected by means of and in the manner provided by the Form No. 1 set out in the Schedule hereto.

4. The forms shall be handed or transmitted by post by the Department of Agriculture to all persons by whom returns are to be made or information given, and shall be sent by post to the Secretary, Department of Agriculture, Fisheries Branch, 3 Kildare Place, Dublin, duly filled up and completed by such persons, at the close of the open fishing season in the year 1939, in so far as salmon and trout are concerned, and on the 31st December, 1939, in so far as eels are concerned.

5. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

6. This Order may be cited for all purposes as the Statistics (Salmon, Sea-Trout and Eels) Order, 1939.

STATISTICS ACT, 1926 .

RETURN SHOWING ALL SALMON, SEA-TROUT AND EELS CAUGHT DURING THE YEAR ENDING 31st DECEMBER, 1939.

As required by the Statistics (Salmon, Sea-Trout and Eels) Order 1939, to be made by all holders of Fishing Licences and (if so required) by all owners, lessees and occupiers of fisheries.

NOTES.

A.—In columns 3, 4 and 5, the actual market value at the time the fish were caught should be given, or if this is not possible, the average market value of the fish during the part of the season in which the fish were caught should be given. A note may be added giving the calculated cost, per pound weight of fish, of carriage to market.

B.—Holders of Rod Licences should complete columns 1 to 4 inclusive. Their returns will be of much additional interest and value if the catch in each river and lake fished during the year is shown separately.

C.—Holders of Net Licences should give in Column 6 an accurate description of the net used, stating the length, depth and size of mesh (stretched knot to knot), of the different parts of the net, and in the case of a draft net, the length of the hauling ropes used. The number of men required to work the net should be added, and, if possible, the cost price of the net and ropes.

D.—Holders of Licences for engines other than rods or nets, should give in Column 6 a precise description of the engine used.

E.—If possible, returns should be made on a separate form for each engine used. In cases where this is not possible the catches of several engines may be included in one form, but only engines of the same kind should be grouped together. If a form be mislaid, a duplicate one may be obtained on application to the Secretary, Department of Agriculture, Fisheries Branch, 3 Kildare Place, Dublin.

F.—Owners, lessees, or occupiers of fisheries required to make the return should fill up the form to the best of their ability.

G.—The form should be completed and forwarded to the Department of Agriculture, Fisheries Branch, 3 Kildare Place, Dublin, in the case of salmon and sea-trout, immediately on the close of the open fishing season in the year 1939, and in the case of eels on the 31st December, 1939.
