STATUTORY RULES AND ORDERS. 1938. No. 282.

AGRICULTURAL PRODUCE (EGGS) (AMENDMENT) REGULATIONS, 1938.

I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Agricultural Produce (Eggs) Acts, 1924 and 1930, and of every and any other power me in this behalf enabling, do by this Order make the following Regulations:—

1. These Regulations may be cited as the Agricultural Produce (Eggs) (Amendment) Regulations, 1938.

2. In these Regulations—

the expression "the Principal Regulations" means the Agricultural Produce (Eggs) Regulations, 1931 (Statutory Rules and Orders, No. 23 of 1931), and every word and expression to which a particular meaning is given by those Regulations has in these Regulations the meaning so given to it; the expression "the Regulations of 1936" means the Agricultural Produce (Eggs) (Amendment) Regulations, 1936 (Statutory Rules and Orders, No. 50 of 1936).

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

4. Article 5 of the Principal Regulations (as amended by Article 5 of the Regulations of 1936) is hereby amended in the following respects and shall be construed and have effect accordingly, that is to say:—

(a) by the insertion in paragraph (1) thereof at the end of the class headed "Preserved Eggs" of the words—

"Extra Selected Sterilised,"

"Selected Sterilised,"

"Medium Sterilised,"

and by the insertion at the end of the class headed "Trade Eggs" of the words "Trade Sterilised," and

(b) by the insertion in paragraph (3) thereof at the end of the sub-paragraph commencing with the words "Medium Pickled" and ending with the word "visible" of three new sub-paragraphs as follows:—

"'Extra Selected Sterilised' shall mean eggs preserved by means of storage in an atmosphere of carbon dioxide gas, of reasonably uniform size and so selected that, while the weight of each great hundred shall be not less than 16 lb., no individual egg shall be included weighing less than 15 lb. per great hundred. Eggs shall be clean, free from stain, and sound in shell, with air-space not exceeding three-eights of one inch in depth, with white of egg clear and firm, not weak and watery, and yolk moderately visible."

"'Selected Sterilised' shall mean eggs preserved by means of storage in an atmosphere of carbon dioxide gas, of reasonably uniform size and so selected that, while the weight of each great hundred shall be not less than 15 lb., no individual egg shall be included weighing less than 14 lb. per great hundred. Eggs shall be clean, free from stain, and sound in shell, with air-space not exceeding three-eighths of one inch in depth, with white of egg clear and firm, not weak and watery, and yolk moderately visible."

"'Medium Sterilised' shall mean eggs preserved by means of storage in an atmosphere of carbon dioxide gas, of reasonably uniform size and so selected that, while the weight of each great hundred shall be not less than 13½ lb. no individual egg shall be included weighing less than 13 lb. per great hundred. Eggs shall be clean, free from stain, sound in shell, with air-space not exceeding three-eights of one inch in depth, with white of egg clear and firm, not weak and watery, and yolk moderately visible," and

(c) by the insertion in paragraph (4) thereof at the end of the sub-paragraph commencing with the words "Trade Pickled" and ending with the word "hundred" of a new sub-paragraph as follows:—

"'Trade Sterilised' shall mean eggs preserved by means of storage in an atmosphere of carbon dioxide gas, clean, free from stain and sound in shell, with air-space not exceeding three-eights of one inch in depth, with white of egg translucent, though it may be weak, and yolk visible, swinging freely but clear of side. No individual egg shall be included which weighs less than 12½ lb. per great hundred."

5. Article 8 of the Principal Regulations (as amended by the Regulations of 1936) is hereby amended in the following respects and shall be construed and have effect accordingly, that is to say:—

(a) by the insertion in sub-paragraph (a) of paragraph (1) thereof after the words "Medium Pickled" of the words—

"Extra Selected Sterilised,"

"Selected Sterilised,"

"Medium Sterilised,"

and by the insertion after the words "Trade Pickled" of the words—

"Trade Sterilised," and

(b) by the deletion of paragraph 4 thereof and by the substitution for the paragraph so deleted of a new paragraph as follows:—

"(4) The description of the grade shall be placed on the upper portion of each end of the package. In the case of cold stored eggs, pickled eggs or sterilised eggs, the description COLD STORED, PICKLED or STERILISED, as the case may be, shall, in addition, be placed on the inside of the end of the package."

6. Article 19 of the Principal Regulations is hereby amended by the insertion of the word "Sterilised" after the word "Pickled" and the said Article shall be construed and have effect accordingly.

7. Paragraph (2) of Article 20 of the Principal Regulations is hereby amended by the insertion after the word "waterglass," of the words "or eggs intended to be preserved by storage in an atmosphere of carbon dioxide gas," and the said paragraph shall be construed and have effect accordingly.
