SHEEP DIPPING (AMENDMENT) ORDER, 1938.

ORDER OF THE MINISTER FOR AGRICULTURE.

The Minister for Agriculture, by virtue and in exercise of the powers conferred on him by the joint operation of the Agriculture Act, 1931 (No. 8 of 1931), and the Diseases of Animals (Ireland) Acts, 1894 to 1938, and of every and any other power him in this behalf enabling, hereby orders as follows:—

1 Short title and commencement.

1.—(1) This Order may be cited as the Sheep Dipping (Amendment) Order, 1938.

(2) This Order shall come into operation on the 1st day of August, 1938.

2 Interpretation.

2. The Interpretation Act, 1937 (No. 38 of 1937) applies to this Order.

3 Definitions.

3. In this Order—

the expression "the Principal Order" means the Sheep Dipping Order, 1937 (Statutory Rules and Orders, No. 169 of 1937);

the expression "the special area" means the area described in the Schedule hereto ; the words "sheep" and "inspector" and the expression "double dipped" have the same respective meanings as in the Principal Order.

4. For the purposes of the Principal Order and this Order the expression "dipping period" shall in respect of the special area and in relation to the year 1938 be construed as meaning the period beginning on the 1st day of October, 1938, and terminating on the 30th day of November, 1938.

5 Restriction on movement and sale of sheep.

5.—(1) Notwithstanding any provision in the Principal Order exempting sheer from dipping, it shall not be lawful during the period beginning on the 1st day of November, 1938 and terminating on the 30th day of November, 1938 to move into or expose for sale in any fair, market, or saleyard in the special area any sheep unless such sheep—

(a) have been double dipped during the dipping period, and

(b) such sheep are accompanied by either—

(i) a declaration, signed by the person who is in possession or is in charge of such sheep, or a certificate by an inspector to the effect that such sheep have been double dipped subsequent to the preceding 30th day of September, or

(ii) by such documentary evidence of dipping as may be prescribed by regulations made by the local authority and for the time being in force.

(2) Article 9 of the Principal Order shall not apply in relation to the movement into, or exposure for sale in any fair, market, or saleyard in the special area, of any sheep, in the period beginning on the 1st day of September, 1938 and terminating on the 31st day of October, 1938.

SCHEDULE.

The Administrative County of Leitrim and so much of the Administrative County of Cavan as lies west of the road which leads from Mullan in Northern Ireland to the border of County Leitrim and passes through Swanlinbar, Derrynacreeve, Airmount and Black-water Bridge.
