SHOPS (CONDITIONS OF EMPLOYMENT) ACT, 1938 (FORM OF APPLICATION TO THE DISTRICT COURT UNDER SECTION 31 (4)) REGULATIONS, 1938.

WHEREAS it is enacted by sub-section (5) of Section 31 of the Shops (Conditions of Employment) Act, 1938 (No. 4 of 1938), that the Minister for Justice may make regulations prescribing the form referred to in sub-section (4) of the said Section 31 as prescribed:

NOW, the Minister for Justice, in exercise of the powers conferred on him by sub-section (5) of Section 31 of the Shops (Conditions of Employment) Act, 1938 (No. 4 of 1938), and of every and any other power him in this behalf enabling, hereby makes the following regulations, that is to say :—

1. These Regulations may be cited as the Shops (Conditions of Employment) Act, 1938 (Form of Application to the District Court under Section 31 (4)) Regulations, 1938.

2. Every application to a Justice of the District Court under sub-section (4) of Section 31 of the Shops (Conditions of Employment) Act, 1938 , shall be in the Form set forth in the Schedule hereto.

SCHEDULE.

SHOPS (CONDITIONS OF EMPLOYMENT) ACT, 1938 .

APPLICATION TO FIX A SUM IN RESPECT OF BOARD OR LODGING OR BOTH BY A MEMBER OF THE STAFF OF A SHOP UNDER SUB-SECTION (4) OF SECTION 31.

WHEREAS :—

1. I am a member of the staff of a shop situate at (a).............................. in which there is carried on the business of (b).......................................... and of which (c).................................................. is the proprietor, and

2. I am entitled to receive as part of my remuneration (d) board or lodgings or board and lodgings, and

3. I have been granted (e)........................ days' annual leave from the............... day of .......................................19...... to the............... day of .......................................19...... (both days inclusive), and

4. The said proprietor and I have been unable to agree upon the sum to be paid to me in respect of (d) board or lodgings or board and lodgings during the said period of annual leave, and

5. The said proprietor has offered to pay me in respect of such (d) board or lodgings or board and lodgings the sum of................................. (f), and

6. I have claimed in respect of such (d) board or lodgings or board and lodgings the sum of (g)................................................made up as follows :—

NOTES.

1. A copy of this form duly filled up must be served on the proprietor of the shop or his representative and on the District Court Clerk not less than ten days before the application is heard.

2. The applicant should before inserting the date on which the application is to be made consult the District Court Clerk.

(d) Strike out whichever is inapplicable

(e) Fill in particulars of annual leave.

(f) If no offer made strike out this paragraph

(g) State amount claimed and give details showing how it is calculated.

(j) Name and address of District Court Clerk
