STATUTORY RULES AND ORDERS. 1938. No. 140.

CATTLE (REGULATION OF EXPORT FROM GREENORE) ORDER, 1938.

The Minister for Agriculture, in exercise of the powers conferred on him by the Agricultural Products (Regulation of Export) Acts, 1933 and 1935, and of every and any other power him in this behalf enabling, hereby orders as follows:—

1. This Order may be cited as the Cattle (Regulation of Export from Greenore) Order, 1938.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order—

the expression "the Minister" means the Minister for Agriculture;

the word "cattle" means any animal which is—

(a) a bovine animal (other than a bull or a cow), or

(b) a bull which has not grown the fifth permanent molar tooth, or

(c) a cow which has grown not more than six permanent incisor teeth;

the expression "the United Kingdom" means the United Kingdom of Great Britain and Northern Ireland;

the word "inspector" means a person authorised by the Minister to act as inspector for the purposes of this Order.

4. It shall not be lawful for any person to export to the United Kingdom from the Port of Greenore any cattle unless—

(a) such cattle have been consigned direct from Northern Ireland and are passing through Greenore in course of transit to the United Kingdom, or

(b) such cattle are presented to an inspector at Greenore for inspection and are either—

(i) already marked by having a portion of the left ear punched in such manner as to have a hole 5/8ths of an inch in diameter therein, or

(ii) marked prior to their export by an inspector by punching a circular hole 5/8ths of an inch in diameter just within the tip of the left ear, or

(c) such person satisfies an inspector either that such cattle are registered pedigree cattle which are being exported for breeding purposes or that such cattle were imported from the United Kingdom for exhibition at a show or sale and are exported direct from such show or sale.

5. Any person who exports or attempts to export any cattle in contravention of this Order or who aids or abets in the exportation or attempted exportation of any cattle in contravention of this Order shall be guilty of an offence under this Order and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds for each animal so exported or attempted to be exported.
