STATUTORY RULES AND ORDERS. 1938. No. 29.

VOCATIONAL EDUCATION ACT, 1930 (PART V) (REGISTERS AND RECORDS) REGULATIONS, 1938.

WHEREAS it is enacted by sub-section (1) of Section 125 of the Vocational Education Act, 1930 (No. 29 of 1930), that the Minister for Education may by order (amongst other things) make regulations prescribing any matter or thing referred to in the said Act as prescribed or to be prescribed :

AND WHEREAS it is enacted by sub-section (2) of Section 65 of the said Act, that it shall be the duty of every enforcing authority to keep the prescribed registers and records for the purposes of Part V of the said Act :

NOW, I, TOMÁS Ó DEIRG, Minister for Education, in exercise of the powers conferred on me by the Vocational Education Act, 1930 (No. 29 of 1930), and of every and any other power me in this behalf enabling, do hereby order and make the following regulations, that is to say :—

1. These Regulations may be cited as the Vocational Education Act, 1930 (Part V) (Registers and Records) Regulations, 1938.

2. In these Regulations—

the expression " the Act " means the Vocational Education Act, 1930 (No. 29 of 1930) ;

the expression " enforcing authority " means an enforcing authority for a district to which Part V of the Act applies.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

4. (1) Every enforcing authority shall keep a register to be called and known as the register of notices and legal proceedings, and such register shall be in the Form V 51 in the Schedule hereto.

(2) Whenever, after a notice is served by an enforcing authority under either Section 66 or Section 67 of the Act, proceedings are taken under either of the said sections, there shall be entered in columns 2 to 12 of the register of notices and legal proceedings kept by such enforcing authority the particulars applicable to such notice and legal proceedings specified at the head of those columns respectively.

(3) Whenever legal proceedings are taken under Section 69 of the Act against the employer of a young person resident in a district to which Part V of the Act applies, there shall be entered in columns 4 to 8 and 10 to 12 of the register of notices and legal proceedings kept by the enforcing authority for such district the particulars applicable to such legal proceedings specified at the head of those columns respectively.

5.—(1) Every enforcing authority shall keep a register to be called and known as the register of warnings and legal proceedings, and such register shall be in the Form V 52 in the Schedule hereto.

(2) Whenever a warning is served under Section 73 of the Act on the parent of a young person resident in a district to which Part V of the Act applies, there shall be entered in columns 2 to 10 of the register of warnings and legal proceedings kept by the enforcing authority for such district the particulars applicable to such warning specified at the head of such columns respectively, and whenever legal proceedings are taken under the said Section 73 in respect of such young person there shall be entered in columns 11, 12 and 13 of the said register the particulars applicable to such legal proceedings specified at the head of those columns respectively.

6. In addition to the register of notices and legal proceedings and the register of warnings and legal proceedings, it shall be the duty of every vocational education committee which is an enforcing authority and which has appointed a sub-committee to exercise and perform any of the powers, duties and functions of such committee under Part V of the Act to require such sub-committee to keep a minute book and to enter in such minute book minutes of the proceedings at every meeting of such sub-committee.

Instructions relating to Form V 51 :—

1. Only the names of young person in respect of whom, after notices (if required) are issued legal proceedings are taken, should be entered.

2. The word " none," where in accordance with the facts of the case in so far as the same is within the knowledge or procurement of the enforcing authority, should be recorded in Column (8).

3. In the case of a second or subsequent prosecution a new entry should be made and appropriate cross references should be entered in the " Observations " column.
