STATUTORY RULES AND ORDERS, 1938. No. 28.

VOCATIONAL EDUCATION ACT, 1930 (PART V), (PRINCIPAL TEACHERS' RETURNS) REGULATIONS, 1938.

WHEREAS it is enacted by Section 125 (1) of the Vocational Education Act, 1930 (No. 29 of 1930), that the Minister for Education may by order (amongst other things) make regulations prescribing any matter or thing referred to in the said Act as prescribed or to be prescribed :

AND WHEREAS these Regulations relate to matters or things referred to in Section 70 of the said Act as prescribed :

NOW, I, TOMÁS Ó DEIRG, Minister for Education, in exercise of the powers conferred on me by the Vocational Education Act, 1930 (No. 29 of 1930), and of every and any other power me in this behalf enabling, do hereby order and make the following regulations that is to say:—

1. These Regulations may be cited as the Vocational Education Act, 1930 (Part V) (Principal Teachers' Returns) Regulations, 1938.

2. In these Regulations the expression " the Act " means the Vocational Education Act, 1930 (No. 29 of 1930).

3. The Interpretation Act, 1937 (No. 38 of 1937) applies to these Regulations.

4.—(1) For the purposes of sub-section (1) of Section 70 of the Act, the prescribed particulars of every young person who is absent from the course of instruction or school at which such young person is enrolled or attending, shall be the following, namely :

(a) the name of such young person,

(b) the address of the parents of such young person,

(c) the name of the employer of such young person, if in employment.

(2) for the purposes of sub-section (1) of Section 70 of the Act, the prescribed particulars of the absences of every young person shall be the following, namely :

(a) the name of such young person,

(b) the dates of the absences of such young person, and

(c) the alleged causes (if any) of such absences.

(3) For the purposes of sub-section (1) of Section 70 of the Act, the particulars mentioned in the foregoing paragraphs of this Regulation shall be made up for each period commencing on Monday and ending on the following Saturday, during which or any part of which the course of instruction or the school at which such young person is enrolled or attending has been open for secular instruction, and such particulars shall be communicated to the appropriate enforcing authority on the Form V. 48 in the Schedule hereto by sending the same by post as soon as possible, and in any case not later than the Tuesday after the last day of the said period to such enforcing authority at its or his official address.

5.—(1) For the purposes of sub-section (2) of Section 70 of the Act, the prescribed particulars of the attendance at and absences from any course of instruction or school of all or any of the young persons attending such course of instruction or school shall be the following particulars, namely :

(a) the number of days on which such course of instruction or such school has been open for secular instruction during the period specified in that behalf in the demand for such particulars, and

(b) the number of days during the said period on which such young persons or young person respectively have or has attended, and

(c) the number of days during the said period on which such young persons or young person respectively have or has been absent.

(2) The respective ages, as stated in the school registers of all or any of the young persons attending a course of instruction or school, and the particulars of the attendance at and the absences from such course of instruction or school of all or any of the young persons required to be supplied by the principal teacher of any such course of instruction or school pursuant to sub-section (2) of Section 70 of the Act, shall be supplied in the Form V. 49 in the Schedule hereto.

6.—(1) For the purposes of sub-section (3) of Section 70 of the Act, the prescribed portion of the period during which a young person was attending a course of instruction or school shall be :

(a) where such young person was attending such course of instruction or school for a period of six months or more, the period of six months ending on the date on which such young person ceased to attend such course of instruction or school, and

(b) where such young person was attending such course of instruction or school for a period of less than six months, the whole period during which such young person attended such course of instruction or school.

(2) Every certificate given by a principal teacher to a parent pursuant to sub-section (3) of Section 70 of the Act shall be on Form V. 50 in the Schedule hereto.

Note 1.—The expression " young person " means a person who has attained the age of fourteen years and has not attained the age of sixteen years.

Note 2.—The expression " principal teacher " includes any deputy, principal or other teacher for the time being acting as or for a principal teacher.

Note 3.—The word " employment " in relation to a young person means employment and occupation in any labour exercised by way of trade or for the purpose of gain to such young person or to any other person.
