DANGEROUS DRUGS ACT, 1934 (APPLICATION OF PART IV TO PREPARATIONS OF ECGONINE, MORPHINE, METHYLMORPHINE AND ETHYLMORPHINE) ORDER, 1937.

WHEREAS it is enacted by sub-section (2) of section 17 of the Dangerous Drugs Act, 1934 (No. 1 of 1934), that if it appears to the Executive Council that any new derivative of morphine or cocaine or of any salts of morphine or cocaine or any other alkaloid of opium or any other drug of whatsoever kind is, or is likely, if improperly used, to be productive of ill-effects substantially of the same character or nature as or analagous to those produced by morphine or cocaine, or is capable of being converted ino a substance which is or is likely, if improperly used, to be productive of such ill-effects, the Executive Council may by order under the said sub-section declare that such new derivative, alkaloid, or other drug shall be a drug to which Part IV of the said Act applies:

AND WHEREAS it appears to the Executive Council that the several preparations (being drugs) specified in the Schedule to this Order are likely, if improperly used, to be productive of ill-effects substantially of the same character or nature as or analogous to those produced by morphine or cocaine and are capable of being converted into substances which are likely, if improperly used, to be productive of such ill-effects:

NOW, THEREFORE, the Executive Council, in exercise of the powers conferred on them by sub-section (2) of section 17 of the Dangerous Drugs Act, 1934 (No. 1 of 1934), and of every and any other power them in this behalf enabling, do hereby order as follows, that is to say:—

1. (1) This Order may be cited as the Dangerous Drugs Act, 1934 (Application of Part IV to Preparations of Ecgonine, Morphine, Methylmorphine and Ethylmorphine) Order, 1937.

(2) This Order shall come into force on the first day of December, 1937.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The several preparations (being drugs) specified in the Schedule to this Order shall be drugs to which Part IV of the Dangerous Drugs Act, 1934 (No. 1 of 1934), applies.

SCHEDULE.

PREPARATIONS (BEING DRUGS) TO WHICH PART IV OF THE DANGEROUS DRUGS ACT, 1934 (No. 1 OF 1934) IS APPLIED.

All preparations of esters of ecgonine or of their respective salts.

All preparations of ecgonine containing less than one-tenth per cent. of ecgonine.

All preparations of esters of morphine.

All preparations admixtures or other substances (except syrupus Codeinæ Phosphatis B.P.C. 1934) containing any proportion of methylmorphine (commonly known as codeine) or ethylmorphine (commonly known as dionin) associated with an inert substance whether solid or liquid.

All preparations, admixtures or other substances containing more than 2.5 per cent. of methylmorphine. or ethylmorphine (calculated as pure drug) associated with any other medicinal substance.
