THE CONTROL OF IMPORTS (REGULATIONS) ORDER, 1937.

THE CONTROL OF IMPORTS (REGULATIONS) ORDER, 1937, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE ON THE 25TH DAY OF MAY, 1937, PURSUANT TO SECTION 13 of THE CONTROL OF IMPORTS ACT, 1934 .

WHEREAS it is enacted by Section 13 of the Control of Imports Act, 1934 , that the Minister for Industry and Commerce may by Order make regulations prescribing any matter or thing which is referred to in the said Act as prescribed or to be prescribed :

AND WHEREAS various things are referred to as prescribed in Sections 2, 7 (as amended by Section 6 of the Control of Imports (Amendment) Act, 1937 ), 8 and 9 of the Control of Imports Act 1934 , and in Section 8 of the Control of Imports (Amendment) Act 1937 :

NOW, THEREFORE, the Minister for Industry and Commerce in exercise of the powers conferred on him by Section 13 of the Control of Imports Act, 1934 , and of every and any other power him in this behalf enabling hereby order as follow, that is to say :—

1. This Order may be cited for all purposes as the Control of Imports (Regulations) Order, 1937.

2. The Interpretation Act, 1923 , applies to the interpretation of this Order and the regulations made thereunder in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In this Order and the regulations made thereunder—

the expression " the Minister " means the Minister for Industry and Commerce.

4. The regulations made by the Control of Imports (Regulations Order, 1934, are hereby revoked but without prejudice to the validity of any procedure thereunder prior to such revocation.

5. The following regulations shall have effect for the purposes of the Control of Imports Acts, 1934 and 1937, that is to say :—

I. For the purposes of the Control of Imports Acts, 1934 and 1937, goods shall not be deemed to have been manufactured in a particular country unless at least twenty five per cent. of their value is the result of cost of labour within that country or of the cost of materials the growth or produce of that country entering into the composition of such goods or of the combined cost of such labour and material.

II. (1) An application for registration in a register of importers shall be made in accordance with Form Q. 1 in the schedule to these regulations.

(2) Every such applicant shall satisfy the Minister as required by sub-section (2) of Section 7 of the Control of Imports Act, 1934 (as amended by Section 6 of the Control of Imports (Amendment) Act, 1937 ) in the following manner, that is to say :—

(i) If he applies as an individual mentioned in paragraph (a) (i) of the said sub-section, by furnishing to the Minister the statutory declaration in Form Q.2 in the schedule to these regulations.

(ii) If he applies as a partnership mentioned in paragraph (a) (ii) of the said sub-section, by furnishing to the Minister the statutory declaration in Form Q.3 in the said schedule.

(iii) If he applies as a company mentioned in paragraph (a) (iii) of the said sub-section, by furnishing to the Minister a statutory declaration, made by the secretary to the company or other officer of the company approved by the Minister for such purpose, in Form Q.4 in the schedule to these regulations, and also the certificate of the company's incorporation or such other evidence of such incorporation as the Minister may in any particular case require.

(iv) If he applies as a person mentioned in paragraph (a) (iv) of the said sub-section, by furnishing to the Minister the statutory declaration in Form Q.5 in the said schedule.

(v) If he applies as a body mentioned in paragraph (b) of the said sub-section, by furnishing to the Minister the statutory declaration, made by the secretary to the body making the application or other person approved by the Minister for such purpose, in Form Q.6 in the said schedule.

(vi) If he applies as a Minister, head of a Department of State, by stating in the application for registration that he is such Minister.

(vii) If he applies as a body mentioned in paragraph (d) of the said sub-section, by stating in the application for registration the statute or order made under statutory authority by which such body is constituted.

(viii) If he applies as a person mentioned in paragraph (e) of the said sub-section, by stating in his application for registration the date of the new manufacture licence held by him under the Control of Manufactures Acts, 1932 to 1935.

(ix) If he applies as a person mentioned in paragraph ( f ) of the said sub-section, by furnishing to the Minister the statutory declaration in Form Q.7 in the said schedule.

III. An application for a licence under Section 8 of the Control of Imports Act, 1934 , shall be made in accordance with Form Q.8 in the schedule to these regulations.

IV. An application for a licence under Section 9 (1) of the Control of Imports Act, 1934 , shall be made in accordance with Form Q.9 in the schedule to these regulations, or in the case of an application in relation to an additional quota in accordance with Form Q.10 in the schedule to these regulations.

V. An application for the removal of a name from a register under paragraph (e) of Section 8 of the Control of Imports (Amendment) Act, 1937 , shall be made in accordance with Form Q.11 in the schedule to these regulations.

NOTE.—This application must be lodged in the office of the Department not less than fourteen clear days before the commencement of the Quota Period in respect of which it is being made (Vide Section 9 (1) of the Control of Imports Act, 1934 ).

NOTE.—This application must be lodged in the office of the Department not later than..................as appointed by the Order fixing the additional Quota (Vide Section 10 (1) of the Control of Imports (Amendment) Act, 1937 ).

(a) This clause is applicable where application is being made by a body not incorporated. If not applicable, it should be struck out.

(b) This clause is applicable where application is being made otherwise than by a body not incorporated. If not applicable, it should be struck out. The full name of the owner if an individual business and of all partners if a partnership business must be given.

(c) Here insert the name of the goods to which the Quota Order applies.

(d) Here insert the weight or quantity and value of goods for the importation of which the licence is applied for.

(e) Here insert the name of the Port or Customs Station through which importation is to be effected.

(f) Here insert particulars of the Quota Period, i.e. First, Second, Third, etc.

(g) Here insert the dates on which the Quota Period begins and ends.

(h) Where a trade name is used, it should be authenticated by the signature of the proprietor or of one of the partners. In the case of an incorporated body or a body not incorporated, the application should be signed by the Secretary or other officer of such body approved by the Minister for Industry and Commerce for such purpose, whose capacity should be stated.
