WIDOWS' AND ORPHANS' PENSIONS (EXCEPTED EMPLOYMENTS)ORDER, 1937 (No. 2).

WIDOWS' AND ORPHANS' PENSIONS ACTS, 1935 TO 1937.

WHEREAS it is enacted by subsection (3) of Section 4 of the Widows' and Orphans' Pensions Act, 1935 , as amended by Section 5 of the Widows' and Orphans' Pensions Act, 1937 , that, where the Minister for Local Government and Public Health is satisfied, as regards any employment in respect of which the conditions mentioned in clause (ii) of paragraph (a) of subsection (1) of the first-mentioned Section are complied with, that, having regard to the nature of such employment, it would not be desirable for such employment to be excepted employment to which the Widows' and Orphans' Pensions Acts, 1935 to 1937, apply, the Minister may by order declare that such employment shall not be an excepted employment to which the Widows' and Orphans' Pensions Acts, 1935 to 1937, apply :

NOW, the Minister for Local Government and Public Health, in exercise of the powers conferred on him by the said subsection (3) of Section 4 of the Widows' and Orphans' Pensions Act, 1935 , as amended by Section 5 of the Widows' and Orphans' Pensions Act, 1937 , hereby orders as follows :—

1. This Order may be cited as the Widows' and Orphans' Pensions (Excepted Employments) Order, 1937 (No. 2).

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In this Order

the expression " the Acts " means the Widows' and Orphans' Pensions Act, 1935 , as amended by any subsequent enactments.

4. The employments specified in the Schedule to this Order shall not be excepted employments to which the Acts apply.

5. This Order shall be deemed to have come into force on the 2nd April, 1937.

SCHEDULE.

Employment under any local or other public authority :—

(a) as Chaplain or other Minister of Religion,

(b) as duly qualified Medical Practitioner,

(c) as Coroner or Deputy Coroner,

(d) as Public Analyst,

(e) as Public Vaccinator,

(f) as Registrar, Assistant Registrar, or Deputy Registrar of births, marriages and deaths,

(g) under a contract of apprenticeship without money payment ;

Employment under any local or other public authority, not being employment within the meaning of Part I (a), (b), (c) or (d) of the First Schedule to the National Insurance Act, 1911, in the execution of contracts not requiring personal service on the part of the employed person.
