DUBLIN DISTRICT MILK BOARD (AMENDMENT) (No. 2) ORDER, 1936.

WHEREAS it is enacted by sub-section (3) of Section 6 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), that the Minister for Agriculture may at any time, at his discretion, by Order revoke or amend a milk (joint district) Order:

AND WHEREAS the following (joint district) order, namely, the Dublin District Milk Board Order (Statutory Rules and Orders, No. 254 of 1936), was made on the 8th day of September, 1936, and the said Order was amended by the Dublin District Milk Board (Amendment) Order, 1936 (Statutory Rules and Orders No. 301 of 1936), made on the 25th day of September, 1936:

NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by sub-section (3) of Section 6 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), and of every and any other power me in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the Dublin District Milk Board (Amendment) (No. 2) Order, 1936.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The Dublin District Milk Board Order, 1936 (Statutory Rules and Orders No. 254 of 1936), is hereby amended by the insertion therein of the following Article in lieu of Article 8 now contained therein and the said Order shall be construed and have effect accordingly, that is to say :—

"8. (I) Every person who carries on at premises situate in the sale district to which this Order relates the business of selling milk, other than a person who is, by virtue of paragraph (2) of this Article, a wholesaler in relation to milk in respect of such sale district, shall in relation to milk be a retailer in respect of such sale district.

(2) Every person—

(a) who carries on at premises situate in the sale district to which this Order relates the business of selling milk, and

(b) who, in the opinion of the Chairman of the Dublin District Milk Board, either—

(i) on the average, taken over such period (exclusive of any part thereof during which, in the opinion of the said chairman, there was an abnormal demand for milk in such sale district) as the chairman may determine, obtained direct from producers of milk not less than two thousand gallons of milk per week, or

(ii) during such period (exclusive of any part thereof during which, in the opinion of the said chairman, there was an abnormal demand for milk in such sale district) as the said chairman may determine, obtained direct from producers of milk not less than seven hundred gallons of milk per week and sold not less than 60 per cent. of such milk in consignments of not less than two gallons each,

shall in relation to milk be a wholesaler in respect of such sale district."
