BEEF VOUCHER (AMENDMENT) (No. 2) REGULATIONS, 1935.

WHEREAS by section 46 of the Slaughter of Cattle and Sheep Act, 1934 (No. 42 of 1934), power is conferred on the Minister for Agriculture to make, after consultation with the Minister for Local Government and Public Health and the Minister for Industry and Commerce, regulations for the purposes therein mentioned in relation to the supply of beef in pursuance of Part IX of that Act by means of beef vouchers:

AND WHEREAS the Beef Voucher Regulations, 1934 (Statutory Rules and Orders No. 351 of 1934), were made by the Minister for Agriculture under the powers conferred on him by the said section 46:

AND WHEREAS it is enacted by sub-section (2) of section 19 of the Slaughter of Cattle and Sheep (Amendment) Act, 1935 (No. 37 of 1935), that on the appointed day Part IX of the said Slaughter of Cattle and Sheep Act, 1934 , as amended by the said Slaughter of Cattle and Sheep (Amendment) Act, 1935 , in so far as it is an enactment providing for the distribution of beef free of charge to recipients, shall cease to have effect and the said Part IX as so amended shall, on the appointed day, become and be an enactment providing for the sale of beef to recipients at a price calculated at the prescribed rate per pound, and be construed and have effect accordingly, and it is enacted by sub-section (3) of the said section 19 that for the purpose of giving effect to the said sub-section (2), certain amendments of the said Part IX shall have effect on and after the appointed day:

AND WHEREAS in exercise of the powers conferred on him by sub-section (1) of section 19 of the said Slaughter of Cattle and Sheep (Amendment) Act, 1935 , the Minister, by Order entitled the Slaughter of Cattle and Sheep (Amendment) Act, 1935 (Section 19, Appointed Day) Order, 1935 (Statutory Rules and Orders No. 601 of 1935), appointed the 30th day of September, 1935, to be the appointed day for the purposes of the said section 19:

NOW, I, Séamas O Riain, Minister for Agriculture, after consultation with the Minister for Local Government and Public Health and the Minister for Industry and Commerce, in exercise of the powers conferred on me by section 46 of the Slaughter of Cattle and Sheep Act, 1934 (No. 42 of 1934), and of every and any other power me in this behalf enabling, do hereby order and make the following Regulations, that is to say:—

1. These Regulations may be cited as the Beef Voucher (Amendment) (No. 2) Regulations, 1935.

2. The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. Every beef voucher shall be in the form S.C.S.8 set forth in the Schedule to these Regulations and shall contain the particulars and details specified in or indicated by the said form.

4. Paragraph 4 of and the First Schedule to the Beef Voucher Regulations, 1934 (Statutory Rules and Orders No. 351 of 1934), shall cease to have effect.

Instructions.

1. This Voucher may be presented during the week mentioned hereon to any registered proprietor at his registered victualling premises; if a registered proprietor to whom this Voucher is presented is unable to supply the quantity of beef mentioned, this Voucher may then be presented to any other registered proprietor.

2. This Voucher must be signed in the space provided by the person receiving the beef and such person must also insert in the said space his address and the date on which he receives the beef.

3. The registered proprietor supplying beef under this Voucher must enter his name and the address of his registered victualling premises in the space provided.

SLAUGHTER OF CATTLE AND SHEEP ACTS, 1934 AND 1935.

PENALTIES.

Any person who sells, buys, barters, pawns, or takes in pawn, or offers to sell, buy, barter, pawn or take in pawn a beef voucher or any beef obtained in exchange for a beef voucher;

or any recipient who applies for or who receives more than one beef voucher in respect of any one week;

or any person who is not for the time being a recipient and who applies for or receives a beef voucher;

or any person who accepts or purchases or offers to accept or purchase in exchange for a beef voucher a quantity of beef less than the quantity of beef stated in such beef voucher, or any goods other than the quantity of beef stated in such beef voucher;

commits an offence and is liable to prosecution and to penalties on conviction.
