MONAGHAN COUNTY SCHEME (AMENDMENT) ORDER, 1935.

TO THE COUNCIL OF THE ADMINISTRATIVE COUNTY OF MONAGHAN; TO THE MONAGHAN BOARD OF HEALTH AND PUBLIC ASSISTANCE; AND TO ALL OTHERS WHOM IT MAY CONCERN:

WHEREAS in pursuance of Section 5 of the Local Government (Temporary Provisions) Act, 1923 (hereinafter referred to as the Act of 1923), the Minister for Local Government did by the Monaghan County Scheme Order, 1923, amend and modify the existing County Scheme relating to the County of Monaghan as set out in the First Schedule to the Act of 1923, in such way as to bring it into conformity with the provisions set forth in the Schedule to the said Order and did substitute the said provisions for the provisions of the said existing County Scheme (which said first-mentioned provisions are in this Order referred to as the Monaghan County Scheme):

AND WHEREAS in pursuance of Section 5 of the Act of 1923, the Monaghan County Scheme was amended by the Monaghan County Scheme (No. 2) Order, 1923, the County Schemes (General Amendment) Order, 1925, and the County Schemes (General Amendment) Order, 1933:

AND WHEREAS the Monaghan County Scheme has come into operation, and the Minister for Local Government and Public Health deems it necessary further to amend the said Scheme in manner hereinafter appearing and has given to the Council of the Administrative County of Monaghan, being the Council of the County to which the said Scheme relates, one month's previous notice of his intention to make such amendment and has taken into consideration any representation which has been made by the said Council within such month in respect of such amendment:

NOW, THEREFORE, the Minister for Local Government and Public Health, in exercise of the powers vested in him by Section 5 of the Act of 1923, as amended by the Local Government (Temporary Provisions) (Amendment) Act, 1924 , and of all other powers in this behalf enabling him, does by this his Order, order and direct as follows, that is to say:—

1. The Monaghan County Scheme shall be and is hereby amended as follows:—

(a) Paragraph (d) of sub-article (i) of Article 15 of the said Scheme shall be deleted therefrom.

(b) The following sub-article shall be inserted in the said Scheme after sub-article (vi) of Article 15 thereof namely:—

(vii) Where the Minister has given his approval to the provision and maintenance by the board of health under paragraph (f) of this Article of an institution not specifically required by this article, the Minister may subsequently withdraw such approval and the Board of Health, shall not, after such withdrawal, continue to provide or maintain such institution.

2. This Order may be cited and referred to as the Monaghan County Scheme (Amendment) Order, 1935, and shall come into operation as from the date hereof.
