WORKERMEN'S COMPENSATION ACT, 1934 (NOTICE OF ACCIDENT BOOK) ORDER, 1934.

WORKMEN'S COMPENSATION ACT, 1934 (NOTICE OF ACCIDENT BOOK) ORDER, 1934, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE PURSUANT TO SECTION 30 of THE WORKMEN'S COMPENSATION ACT, 1934 (No. 9 of 1934).

WHEREAS it is enacted by Section 11 of the Workmen's Compensation Act, 1934 , that the Minister for Industry and Commerce may by order make regulations in respect of any matter or thing which is referred to in the said Act as prescribed or to be prescribed :

AND WHEREAS it is enacted by Section 30 of the said Act that there shall be kept at every mine, quarry, factory or workshop an accident book in the prescribed form in which the prescribed particulars of any accident happening to any person employed at such mine, quarry, factory or workshop may be entered by such person or some other person acting on his behalf.

NOW, THEREFORE, the Minister for Industry and Commerce, in exercise of the powers conferred on him by Section 11 of the Workmen's Compensation Act, 1934 , and of every and any other power him in this behalf enabling, makes the following order, that is to say :—

1. This Order may be cited for all purposes as the Workmen's Compensation Act, 1934 (Notice of Accident Book) Order, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. This Order shall come into operation on the first day of August, 1934.

4. The following Regulations shall have effect for the purposes of Section 30 of the Workmen's Compensation Act, 1934 , that is to say :—

1. The book which shall be kept at every mine, quarry, factory or workshop in which particulars of any accident happening to any person employed at such mine, quarry, factory or workshop may be entered, by such person or some other person acting on his behalf shall be in the form set out in the Schedule to this Order, and the particulars to be inserted in the said book shall be those set out in the said form.

2. The dimensions of the said book, when open, shall be thirteen inches in length and sixteen inches in width.

INSTRUCTIONS.

1. The purpose of this Accident Book, which it is the duty of the owner or occupier to keep under the provisions of Section 30 of the Workmen's Compensation Act, 1934 , is to assist the workman in giving notice of accident to his employer as required by Section 28 of the Act, and an entry in this Book, if made as soon as practicable after the happening of the accident, will be sufficient notice of the accident for the purposes of the Act.

2. This Accident Book has to be kept at every mine, quarry, factory or workshop and also at every other works or premises to which any of the provisions of the Factory and Workshop Acts, 1901 to 1920, apply, as for example, docks, wharves, quays and warehouses.

3. This Book must be kept at such place as to be readily accessible at all reasonable times to any injured workman employed at the mine, quarry, factory or workshop, or other works or premises to which any of the provisions of the Factory and Workshop Acts, 1901 to 1920, apply, and to any person bona fide acting on his behalf.

4. Particulars of an accident may be entered herein either by the injured workman himself or by someone on his behalf.

5. If the Accident Book is not kept as required, the mine, quarry, factory or workshop or other works or premises hereinbefore referred to will be deemed not to be kept in conformity with the Factory and Workshop Acts, and the owner or occupier will be liable on summary conviction to a fine as provided in Section 135 of the Factory and Workshop Act, 1901.

6. The Accident Book when filled up should be preserved for a reasonable period after the date of the last entry.
