SPECIAL ORDER MADE BY THE MINISTER FOR LOCAL GOVERNMENT AND PUBLIC HEALTH, UNDER SECTION 28 (1) (c) OF THE NATIONAL HEALTH INSURANCE ACT, 1918, EXCLUDING CERTAIN EMPLOYMENT FROM PART I OF THE FIRST SCHEDULE TO THE NATIONAL INSURANCE ACT, 1911.

DATED THIS 9TH DAY OF AUGUST, 1934.

WHEREAS by Section 28 (1) (c) of the National Health Insurance Act, 1918, read with Section 81 (17) of the National Insurance Act, 1911 (hereinafter called "the principal Act") it is provided that employment as a teacher of any class which may be specified in a special order made by the Insurance Commissioners as being a class in the case of which the conditions of employment are similar to the conditions of employment prevailing in the case of teachers to whom the National School Teachers (Ireland) Act, 1879, applies shall be deemed to be included among the excepted employments specified in Part II of the First Schedule to the Principal Act;

AND WHEREAS the National School Teachers' Superannuation Scheme, 1934, S.R.O. No. 23 of 1934 , made by the Minister for Education and confirmed by the Oireachtas, provides that as from the 1st day of April, 1934, a pension shall, subject to the conditions of the scheme, be payable on retirement to each person employed as a lay assistant teacher in a monastery or convent national school or as a junior assistant mistress in a national school;

AND WHEREAS it is provided by the Irish Insurance Commissioners (Transfer of Functions) Order, 1933, that all the jurisdictions, powers, duties and functions of the Irish Insurance Commissioners are transferred to and conferred and imposed on the Minister for Local Government and Public Health;

Now, therefore, the Minister for Local Government and Public Health, in pursuance of the powers conferred on him by the National Health Insurance Acts, 1911 to 1933, and of every and any other power him in this behalf enabling, after consultation with the Minister for Education, do hereby order as follows:—

1. Employment as a teacher in the classes specified in the Schedule to this Order is employment in a class in the case of which the conditions of employment are similar to the conditions prevailing in the case of teachers to whom the National School Teachers (Ireland) Act, 1879, applies.

2. —(1) This Order may be cited as the National Health Insurance (Assistant Teachers) Exclusion Order, 1934.

(2) The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. This Order shall be deemed to have come into force on the 1st April, 1934.

SCHEDULE.

Class of employment as specified in Article 1 above and, therefore, excluded from being employment within the meaning of Part I of the principal Act.

Employment as a person who is recognised by and receives salary from the Minister for Education as a lay assistant teacher in a monastery or convent national school or as a junior assistant mistress in a national school.
