DAIRY PRODUCE (BUTTER LEVY AND BOUNTY RATES) REGULATIONS, 1934.

WHEREAS it is enacted by Section 6 of the Dairy Produce (Price Stabilisation) Act, 1932 (No. 10 of 1932), as amended by the Dairy Produce (Price Stabilisation) Act, 1933 (No. 4 of 1933) that the Minister for Agriculture may make regulations prescribing the general rate for the purposes of a levy on butter under the said Act, but the general rate so prescribed by any such regulations shall not exceed one half of the rate of the butter duty, and that in making regulations under the said section prescribing the general rate the said Minister may prescribe different general rates in respect of creamery butter and butter which is not creamery butter:

AND WHEREAS it is enacted by sub-section (1) of Section 7 of the said first-mentioned Act, as so amended, that the said Minister may make regulations prescribing the special rate for the purposes of levy on butter under the said Act, but the special rate prescribed by any such regulations shall not exceed the general rate for creamery butter (being the rate in respect of creamery butter for the time being in force by virtue of regulations made under Section 6 of the said Act) nor, in respect of the year ending on the 31st day of March, 1934, be less than fifty per cent. of the general rate for creamery butter nor, in respect of the year ending on the 31st day of March, 1935, be less than seventy-five per cent. of the general rate for creamery butter:

AND WHEREAS it is enacted by sub-section (1) of Section 30 of the said first-mentioned Act that the said Minister may, subject to the provisions of the said Section 30, make regulations prescribing the general rate of bounty on creamery butter, but the general rate so prescribed by any such regulations shall not exceed the rate of the butter duty nor exceed such sum per pound as would, if added to the price per pound which is certified in such regulations to be in the opinion of the said Minister the average free on rail price per pound of creamery butter exported during such period previous to the making of such regulations as the said Minister may select and specify in such regulations, amount to one shilling and three pence half-penny, and it is enacted by sub-section (4) of the said Section 30 that the said Minister may, subject to the provisions of the said Section 30, make regulations prescribing the rate of bounty on factory butter, but the rate of bounty so prescribed shall not exceed the rate of the butter duty, and it is enacted by sub-section (5) of the said Section 30 that the said Minister may, subject to the provisions of the said Section 30, make regulations prescribing the rate of bounty on farm butter, but the rate of bounty so prescribed shall not exceed the rate of bounty on factory butter:

AND WHEREAS it is enacted by sub-section (6) of the said Section 30 that in prescribing the rates of bounty on creamery butter, factory butter, and farm butter respectively the said Minister shall have regard to the several matters specified in the said sub-section (6):

AND WHEREAS in making these regulations the said Minister has had regard to the several matters specified in the said sub-section (6):

AND WHEREAS it is enacted by sub-section (1) of Section 36 of the said first-mentioned Act that the said Minister may make regulations prescribing the rate at which bounties are to be paid under Part VII of the said Act in respect of milk products and different rates may be prescribed in respect of different milk products:

AND WHEREAS the rate of the butter duty is eight pence per pound:

NOW, THEREFORE, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Dairy Produce (Price Stabilisation) Acts, 1932 and 1933, and of every and any other power me in this behalf enabling do hereby make the following regulations, that is to say:—

PART I. PRELIMINARY AND GENERAL.

1. These regulations may be cited for all purposes as the Dairy Produce (Butter Levy and Bounty Rates) Regulations, 1934.

2. These regulations shall come into force immediately upon the making thereof.

3. In these regulations the expression "the Act" means the Dairy Produce (Price Stabilisation) Act, 1932 (No. 10 of 1932).

4. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

5. The Dairy Produce (Bounty Rates) Regulations, 1934, are hereby revoked.

PART II. RATES OF LEVY ON BUTTER.

6.—(1) The general rate for the purposes of a levy on creamery butter under the Act shall be three pence half-penny per pound.

(2) The general rate for the purposes of a levy on butter which is not creamery butter under the Act shall be three pence per hundredweight.

7. The special rate for the purposes of a levy on butter under the Act shall be two and five-eighth pence per pound.

PART III. RATES OF BOUNTY ON BUTTER.

8. It is hereby certified that in the opinion of the Minister for Agriculture the average free on rail price per pound of creamery butter exported during the period of four weeks ended on the day immediately preceding the date of these regulations was seven pence half-penny.

9.—(1) The general rate of bounty on creamery butter shall be six pence half-penny per pound.

(2) The rate of bounty on factory butter shall be three pence per hundredweight.

(3) The rate of bounty on farm butter shall be three pence per hundredweight.

PART IV. RATES OF BOUNTIES ON MILK PRODUCTS.

10. The rate at which bounties are to be paid under Part VII of the Act in respect of every milk product shall be three pence per pound of the butter equivalent of such milk product.
