STATUTORY RULES AND ORDERS. 1933. No. 167.

BACON AND PIGS (REGULATION OF EXPORT), ORDER 1933.

WHEREAS it is enacted by subsection (1) of section 2 of the Agricultural Products (Regulation of Export) Act, 1933 (No. 26 of 1933), that if any country to which any agricultural product is usually exported from Saorstát Eireann establishes any system of restriction or control of the import of that agricultural product into that country from Saorstát Eireann, the Minister for Agriculture may by order (in the said Act referred to as an export order) regulate and control the export of that agricultural product to that country from Saorstát Eireann in such manner as appears to him to be calculated to secure for exporters from Saorstát Eireann the maximum benefit permitted by the said system of restriction and control so established by such country and in particular may, without prejudice to the generality of the foregoing provision, by such order provide for all or any of the following matters, that is to say—

(a) for the registration of persons engaged in exporting such product to such country;

(b) for the control and restriction of the export of such product to such country from Saorstát Eireann;

(c) for requiring registered persons to export to such country during any specified period or periods a specified quantity of such product not exceeding the quantity such persons respectively undertake to export during such period or periods;

(d) for regulating and controlling any alternative export to such country which may for the time being be permitted;

(e) for securing the making of returns;

(f) for making specified infringements of such order offences punishable on summary conviction and fixing the penalties for such offences;

AND WHEREAS it is enacted by subsection (3) of section 3 of the said Act that the said Minister may in any export order provide that where he incurs expense under the said section by reason or in consequence of the failure of any person to do any specified thing which such person is authorised or required by or under such order to do, the said Minister may recover such expense from such person as a simple contract debt, and the said Minister may by such order provide that a certificate of the said Minister shall be conclusive evidence of the incurring of such expense and of the amount of such expense;

AND WHEREAS the Government of the United Kingdom of Great Britain and Northern Ireland, being a country to which the following agricultural product, that is to say, bacon, is usually exported from Saorstát Eireann, has established a system of restriction or control of the export of that agricultural product into that country from Saorstát Eireann;

AND WHEREAS the said system extends to pig carcases intended for conversion into bacon and live pigs intended for conversion into bacon;

NOW, THEREFORE, I, SEAMUS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Agricultural Products (Regulation of Export) Act, 1933 (No. 26 of 1933), and of every and any other power me in this behalf enabling, do hereby order as follows:—

1 Short title.

1. This Order may be cited for all purposes as the Bacon and Pigs (Regulation of Export) Order, 1933.

2 Definitions.

2. In this Order—

the expression "the Act" means the Agricultural Products (Regulation of Export) Act, 1933 (No. 26 of 1933);

the expression "the Minister" means the Minister for Agriculture;

the word "bacon" includes ham;

the word "export" means export from Saorstát Eireann;

the expression "the appointed day" means the 25th day of December, 1933.

3 Application of the Interpretation Act, 1923 .

3. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

4 Quota periods, bacon quotas, pig quotas and carcase quotas.

4. —(1) Every period which shall hereafter be declared by an order (in this Order referred to as a quota period order) made by the Minister under section 2 of the Act to be a quota period shall, while such order remains in force, be a quota period for the purposes of this Order, and the expression "quota period" shall in this Order be construed and have effect accordingly.

(2) Every definite amount of bacon which shall hereafter be declared by an order made by the Minister under section 2 of the Act to be the bacon quota in respect of a particular quota period shall, while such order continues in force, be the bacon quota for the purposes of this Order in respect of that particular quota period.

(3) Every definite number of pigs which shall hereafter be declared by an order made by the Minister under section 2 of the Act to be the pig quota in respect of a particular quota period shall, while such order continues in force, be the pig quota for the purposes of this Order in respect of that particular quota period.

(4) Every definite quantity of pig carcases which shall hereafter be declared by an order made by the Minister under section 2 of the Act to be the carcase quota in respect of a particular quota period shall, while such order continues in force, be the carcase quota for the purposes of this Order in respect of that particular quota period.

5 Registers to be kept by the Minister.

5. The Minister shall cause to be kept—

(a) a register to be called and known as the register of bacon exporters; and

(b) a register to be called and known as the register of pig exporters; and

(c) a register to be called and known as the register of carcase exporters.

6 Registration.

6. —(1) Any person who is engaged in the business of manufacturing bacon and who during the appointed period received into his factory and there manufactured into bacon not less than five hundred pigs or pig carcases may, before the appointed day, apply, in accordance with this Article, to the Minister to be registered in the register of bacon exporters, and, on receipt of any such application duly made before the appointed day by a person entitled under this paragraph to make such application, the Minister may at his absolute discretion, register or refuse to register the applicant in such register.

(2) Any person who is engaged or proposes to engage in the business of manufacturing bacon may, on or after the appointed day, apply in accordance with this Article to the Minister to be registered in the register of bacon exporters and the Minister may, on receipt of any such application, at his absolute discretion, register or refuse to register the applicant in such register.

(3) Any person who is engaged in the business of exporting to Great Britain or Northern Ireland live fat pigs intended for conversion into bacon and who during the appointed period exported to Great Britain or Northern Ireland not less than five hundred such pigs may, before the appointed day, apply, in accordance with this Article, to the Minister to be registered in the register of pig exporters, and, on receipt of any such application duly made before the appointed day by a person entitled under this paragraph to make such application, the Minister may, at his absolute discretion, register or refuse to register the applicant in such register.

(4) Any person who is engaged or proposes to engage in the business of exporting to Great Britain or Northern Ireland live fat pigs intended for conversion into bacon may, on or after the appointed day, apply, in accordance with this Article, to the Minister to be registered in the register of pig exporters, and the Minister may, on receipt of any such application, at his absolute discretion, register or refuse to register the applicant in such register.

(5) Any person who is engaged in the business of exporting to Great Britain or Northern Ireland pig carcases, intended for conversion into bacon, and who during the appointed period exported to Great Britain or Northern Ireland not less than five hundred pig carcases intended for conversion into bacon, may, before the appointed day, apply, in accordance with this Article, to the Minister to be registered in the register of carcase exporters, and, on receipt of any such application duly made before the appointed day by a person entitled under this paragraph to make such application, the Minister may, at his absolute discretion, register or refuse to register the applicant in such register.

(6) Any person, being a bacon curer in Northern Ireland recognised for the purpose by the Minister under paragraph (d) of subsection (10) of section 40 of the Agricultural Produce (Fresh Meat) Act, 1930 (No. 10 of 1930), who during the appointed period received into his factory and there manufactured into bacon not less than five hundred pig carcases, the produce of Saorstát Eireann, may, before the appointed day, apply, in accordance with this Article, to the Minister to be registered in the register of carcase exporters, and, on receipt of any such application duly made before the appointed day by a person entitled under this paragraph to make such application, the Minister may, at his absolute discretion, register or refuse to register the applicant in such register.

(7) Any person who is engaged or proposes to engage in the business of exporting to Great Britain or Northern Ireland pig carcases intended for conversion into bacon, or any person, being a bacon curer in Northern Ireland recognised for the purpose by the Minister under paragraph (d) of subsection (10) of section 40 of the Agricultural Produce (Fresh Meat) Act, 1930 , may, on or after the appointed day, apply in accordance with this Article to the Minister to be registered in the register of carcase exporters, and the Minister may, on receipt of any such application, at his absolute discretion, register or refuse to register the applicant in such register.

(8) The following provisions shall have effect in relation to applications under this Article, that is to say—

(a) where a person desires to be registered in two or more registers he shall send a separate application for registration in each such register;

(b) every application for registration in the register of bacon exporters shall—

(i) if made under paragraph (1) of this Article, be in the form No. 1 in the Schedule to this Order or to the like effect, and contain the particulars asked for or otherwise indicated in such form; and

(ii) it made under paragraph (2) of this Article, be in such form as the Minister may require;

(c) every applicant for registration in the register of bacon exporters shall, when so required by the Minister, send to the Minister an undertaking (in this Order referred to as an export (bacon) undertaking) in the form No. 2 in the Schedule to this Order whereby the applicant undertakes to export to Great Britain and Northern Ireland if so required by the Minister, in each period specified in such undertaking the amount of bacon specified in such undertaking;

(d) every application for registration in the register of pig exporters shall—

(i) if made under paragraph (3) of this Article, be in the form No. 3 in the Schedule to this Order or to the like effect, and contain the particulars asked for or otherwise indicated in such form; and

(ii) if made under paragraph (4) of this Article, be in such form as the Minister may require;

(e) every applicant for registration in the register of pig exporters shall, when so required by the Minister, send to the Minister an undertaking (in this Order referred to as an export (pig) undertaking) in the form No. 4 in the Schedule to this Order whereby the applicant undertakes to export to Great Britain or Northern Ireland, if so required by the Minister, in each period specified in such undertaking the number of pigs, intended for conversion into bacon, specified in such undertaking;

(f) every application for registration in the register of carcase exporters shall—

(i) if made under paragraph (5) of this Article, be in the form No. 5 in the Schedule to this Order or to the like effect, and contain the particulars asked for or otherwise indicated in such form; and

(ii) if made under paragraph (6) of this Article, be in the form No. 6 in the Schedule to this Order or to the like effect, and contain the particulars asked for or otherwise indicated in such form; and

(iii) if made under paragraph (7) of this Article, be in such form as the Minister may require;

(g) every applicant for registration in the register of carcase exporters shall, when so required by the Minister, send to the Minister an undertaking (in this Order referred to as an export (carcase) undertaking) in the form No. 7 in the Schedule to this Order whereby the applicant undertakes to export to Great Britain or Northern Ireland, if so required by the Minister, in each period specified in such undertaking the amount of carcases of pigs, intended for conversion into bacon, specified in such undertaking.

(9) In this Article the expression "the appointed period" means the period commencing on the 1st day of January, 1931, and ending on the 31st day of December, 1932.

(10) If any person in any application under this Article makes any statement which is false or misleading in any material respect, such person shall be guilty of an offence under this Article, and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.

(11) References in this Order to a registered bacon exporter, a registered pig exporter and a registered carcase exporter shall be construed as references to a person for the time being registered in the register of bacon exporters, a person for the time being registered in the register of pig exporters, and a person for the time being registered in the register of carcase exporters, respectively.

7 Allotment and re-allotment of bacon quota amongst registered bacon exporters.

7. —(1) As soon as may be after the appointed day and the making of the first quota period order, the Minister shall, subject to the provisions of this Article, allot the bacon quota in respect of each quota period to which such order relates between such registered bacon exporters, being registered bacon exporters who were registered in the register of bacon exporters in pursuance of paragraph (1) of Article 6, and who have sent to the Minister an export (bacon) undertaking in respect of each such period, and in such proportions as the Minister thinks proper.

(2) Whenever the Minister makes a second or any subsequent quota period order, the Minister shall, subject to the provisions of this Article, allot the bacon quota in respect of each quota period to which such order relates between such registered bacon exporters, being registered bacon exporters who, in pursuance of a request by the Minister, have sent to the Minister an export (bacon) undertaking in respect of each such period, and in such proportions as the Minister thinks proper.

(3) Where, after the allotment mentioned in paragraph (1) of this Article, any portion of the bacon quota in respect of any quota period is for the time being not allotted to any registered bacon exporter, the Minister may, subject to the provisions of this Article, either, as he thinks fit, allot such portion to one registered bacon exporter or allot such portion between such registered bacon exporters and in such proportions as the Minister thinks proper.

(4) Where any registered bacon exporter fails in any quota period to export to Great Britain or Northern Ireland the amount of the bacon quota for the time being allotted to him in respect of such period, the Minister may reduce in respect of every subsequent quota period the amount of the bacon quota in respect of such period previously allotted to such exporter.

(5) References in this Order to the bacon sub-quota for a registered bacon exporter in respect of a quota period shall be construed as references to the portion or portions of the bacon quota in respect of such period for the time being allotted under this Article to such exporter.

(6) The Minister shall not exercise the powers conferred on him by this Article, so as to allot to any registered bacon exporter, without the consent of such exporter, in respect of any quota period a portion or portions of the bacon quota in respect of such period greater than the amount specified in the export (bacon) undertaking of such exporter in respect of such period.

8 Allotment and re-allotment of pig quota amongst registered pig exporters.

8. —(1) As soon as may be after the appointed day and the making of the first quota period order, the Minister shall, subject to the provisions of this Article, allot the pig quota in respect of each quota period to which such order relates between such registered pig exporters, being registered pig exporters who were registered in the register of bacon exporters in pursuance of paragraph (3) of Article 6, and who have sent to the Minister an export (pig) undertaking in respect of each such period, and in such proportions as the Minister thinks proper.

(2) Whenever the Minister makes a second or any subsequent quota period order, the Minister shall, subject to the provisions of this Article, allot the pig quota in respect of each quota period to which such order relates, between such registered pig exporters, being registered pig exporters who, in pursuance of a request by the Minister, have sent to the Minister an export (pig) undertaking in respect of each such period, and in such proportions as the Minister thinks proper.

(3) Where, after the allotment mentioned in paragraph (1) of this Article, any portion of the pig quota in respect of any quota period is for the time being not allotted to any registered pig exporter, the Minister may, subject to the provisions of this Article, either, as he thinks fit, allot such portion to one registered pig exporter or allot such portion between such registered pig exporters and in such proportions as the Minister thinks proper.

(4) Where any registered pig exporter fails in any quota period to export to Great Britain or Northern Ireland the amount of the pig quota for the time being allotted to him in respect of such period, the Minister may reduce in respect of every subsequent quota period the amount of the pig quota in respect of such period previously allotted to such exporter.

(5) References in this Order to the pig sub-quota for a registered pig exporter in respect of a quota period shall be construed as references to the portion or portions of the pig quota in respect of such period for the time being allotted under this Article to such exporter.

(6) The Minister shall not exercise the powers conferred on him by this Article, so as to allot to any registered pig exporter, without the consent of such exporter, in respect of any quota period a portion or portions of the pig quota in respect of such period greater than the amount specified in the export (pig) undertaking of such exporter in respect of such period.

9 Allotment and re-allotment carcase quota amongst registered carcase exporters.

9. —(1) As soon as may be after the appointed day and the making of the first quota period order, the Minister shall, subject to the provisions of this Article, allot the carcase quota in respect of each quota period to which such order relates between such registered carcase exporters, being registered carcase exporters who were registered in the register of carcase exporters in pursuance of paragraph (5) or paragraph (6) of Article 6, and who have sent to the Minister an export (carcase) undertaking in respect of each such period, and in such proportions as the Minister thinks proper.

(2) Whenever the Minister makes a second or any subsequent quota period order, the Minister shall, subject to the provisions of this Article, allot the carcase quota in respect of each quota period to which such order relates between such registered carcase exporters, being registered carcase exporters who, in pursuance of a request by the Minister, have sent to the Minister an export (carcase) undertaking in respect of each such period, and in such proportions as the Minister thinks proper.

(3) Where, after the allotment mentioned in paragraph (1) of this Article, any portion of the carcase quota in respect of any quota period is for the time being not allotted to any registered carcase exporter, the Minister may, either, as he thinks fit, allot such portion to one registered carcase exporter or allot such portion between such registered carcase exporters and in such proportions as the Minister thinks proper.

(4) Where any registered pig exporter fails in any quota period to export to Great Britain or Northern Ireland the amount of the pig quota for the time being allotted to him in respect of such period, the Minister may reduce in respect of every subsequent quota period the amount of the pig quota in respect of such period previously allotted to such exporter.

(5) References in this Order to the pig sub-quota for a registered pig exporter in respect of a quota period shall be construed as references to the portion or portions of the pig quota in respect of such period for the time being allotted under this Article to such exporter.

(6) The Minister shall not exercise the powers conferred on him by this Article, so as to allot to any registered pig exporter, in respect of any quota period a portion or portions of the pig quota in respect of such period greater than the amount specified in the export (pig) undertaking of such exporter in respect of such period.

10 Export permits.

10. —(1) The Minister shall cause to be issued in respect of every quota period to every registered bacon exporter to whom a bacon sub-quota has been allotted in respect of such period permits (in this Order referred to as bacon (export) permits) covering and referable to the bacon sub-quota of such exporter in respect of such quota period.

(2) The Minister shall cause to be issued in respect of every quota period to every registered pig exporter to whom a pig sub-quota has been allotted in respect of such period permits (in this Order referred to as pig (export) permits) covering and referable to the pig sub-quota of such exporter in respect of such quota period.

(3) The Minister shall cause to be issued in respect of every quota period to every registered carcase exporter to whom a carcase sub-quota has been allotted in respect of such period permits (in this Order referred to as carcase (export) permits) covering and referable to the carcase sub-quota of such exporter in respect of such quota period.

(4) Every permit issued under this Article shall be in such form and contain such directions and instructions in respect of the use thereof and such identifying particulars as the Minister thinks proper.

(5) Where any permits issued under this Article in respect of a quota period remain at the expiration of such period in the hands of the person to whom the same were issued, such person shall within seven days after the expiration of such period deliver the same to the Minister, and if such person makes default in complying with the foregoing provisions of this paragraph such person shall be guilty of an offence under this paragraph and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds, and, in the case of a continuing offence, a further fine not exceeding ten pounds for each day during which the default continues.

(6) If any person forges or unlawfully has in his possession any permit issued under this Article, such person shall be guilty of an offence under this Article and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds.

11 Consignment certificates.

11. —(1) The Minister shall from time to time cause to be issued to every registered bacon exporter to whom any bacon (export) permits have been issued copies of the form of a document (in this Order referred to as a bacon consignment certificate) to be used in accordance with this Order on the occasion of the export of any consignment of bacon by such exporter.

(2) The Minister shall from time to time cause to be issued to every registered pig exporter to whom any pig (export) permits have been issued copies of the form of a document (in this Order referred to as a pig consignment certificate) to be used in accordance with this Order on the occasion of the export of any consignment of pigs by such exporter.

(3) The Minister shall from time to time cause to be issued to every registered carcase exporter to whom any carcase (export) permits have been issued copies of the form of a document (in this Order referred to as a carcase consignment certificate) to be used in accordance with this Order on the occasion of the export of any consignment of pig carcases by such exporter.

(4) The form of every consignment certificate shall be such as the Minister directs and shall contain such directions in respect of the use thereof as the Minister thinks proper.

12 Export of bacon to Great Britain or Northern Ireland.

12. —(1) Subject to the provisions of this Article, it shall not be lawful for any person to export to Great Britain or Northern Ireland a consignment of bacon in any quota period unless—

(a) such person is a registered bacon exporter, and

(b) such person at the time and place of exportation delivers to the proper officer of customs and excise bacon (export) permits issued to such person by the Minister, applicable to such quota period, and covering such consignment, and

(c) such person at the said time and place also delivers to the said officer a bacon consignment certificate referable to such consignment and duly completed by such person in accordance with the directions set out thereon, and

(d) such person complies with such other directions, in respect of the use of such completed bacon consignment certificate as are set out thereon.

(2) Every person who exports or attempts to export to Great Britain or Northern Ireland any bacon in contravention of this Article shall be guilty of an offence under this Article.

(3) Every person who shall carry by land or sea or air for reward any bacon which is being or is intended to be exported in contravention of this Article shall, if such carrying is done in the course of or for the purpose of the exportation of such bacon, be guilty of an offence under this Article, unless such person proves that he did not know and could not reasonably have known that such bacon was being exported in contravention of this Article.

(4) Every person guilty of an offence under this Article shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds.

(5) This Article shall not apply to any bacon exported by the Minister.

13 Statutory obligation of registered bacon exporters.

13. —(1) It shall be the duty of every registered bacon exporter during every quota period to export to Great Britain or Northern Ireland bacon equal in amount to the bacon sub-quota of such exporter in respect of such period, and references in this Order to the statutory obligation of a registered bacon exporter in respect of a quota period shall be construed as references to the obligation imposed on him by this paragraph in respect of such period.

(2) Where any consignment of bacon is in any quota period exported by a registered bacon exporter to Great Britain or Northern Ireland in contravention of the immediately preceding Article, the exportation of such consignment shall not, for the purposes of this Order, be deemed to be a compliance or a partial compliance with the statutory obligation of such exporter in respect of such quota period.

(3) If any registered bacon exporter in any quota period fails to comply with his statutory obligation in respect of such period, the Minister may, unless such exporter has during such period exported at least ninety-five per cent. of his sub-quota in respect of such period, cancel the registration of such exporter in the register of bacon exporters.

14 Statutory obligation of registered pig exporters.

14. —(1) It shall be the duty of every registered pig exporter during every quota period to export to Great Britain or Northern Ireland pigs equal in amount to the pig sub-quota of such exporter in respect of such period, and references in this Order to the statutory obligation of a registered pig exporter in respect of a quota period shall be construed as references to the obligation imposed on him by this paragraph in respect of such period.

(2) The exportation to Great Britain or Northern Ireland by a registered pig exporter during a quota period of a consignment of pigs shall not, for the purposes of this Order, be deemed to be a compliance or partial compliance by such exporter with his statutory obligation in respect of such quota period unless such exporter—

(a) has delivered at the time and place of exportation to the proper officer of customs and excise pig (export) permits referable to and covering the amount of such consignment, and

(b) has also delivered at the said time and place to the said officer a pig consignment certificate referable to such consignment and duly completed by such exporter in accordance with the directions set out thereon, and

(c) complies with such other directions in respect of the use of such completed pig consignment certificate as are set out thereon.

(3) If any registered pig exporter in any quota period fails to comply with his statutory obligation in respect of such period, the Minister may, unless such exporter has during such period exported at least ninety-five per cent. of his sub-quota in respect of such period, cancel the registration of such exporter in the register of pig exporters.

15 Export of pig carcases to Northern Ireland.

15. —(1) Subject to the provisions of this Article, it shall not be lawful for any person to export to Northern Ireland a consignment of pig carcases in any quota period unless—

(a) such person is a registered carcase exporter, and

(b) such person at the time and place of exportation delivers to the proper officer of customs and excise carcase (export) permits issued to such person by the Minister, applicable to such quota period, and covering such consignment, and

(c) such person at the said time and place also delivers to the said officer a carcase consignment certificate referable to such consignment and duly completed by such person in accordance with the directions set out thereon, and

(d) such person complies with such other directions, in respect of the use of such completed carcase consignment certificate, as are set out thereon.

(2) Every person who exports or attempts to export to Northern Ireland any pig carcases in contravention of this Article shall be guilty of an offence under this Article.

(3) Every person who shall carry by land or sea or air for reward any pig carcases which are being or are intended to be exported in contravention of this Article shall, if such carrying is done in the course of or for the purpose of the exportation of such carcases, be guilty of an offence under this Article, unless such person proves that he did not know and could not reasonably have known that such carcases were being exported in contravention of this Article.

(4) Every person guilty of an offence under this Article shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds.

(5) This Article shall not apply to any pig carcases exported by the Minister.

16 Statutory obligation of registered carcase exporters.

16. —(1) It shall be the duty of every registered carcase exporter during every quota period to export to Great Britain or Northern Ireland pig carcases equal in amount to the carcase sub-quota of such exporter in respect of such period, and references in this Order to the statutory obligation of a registered carcase exporter in respect of a quota period shall be construed as references to the obligation imposed on him by this sub-paragraph in respect of such period.

(2) Where any consignment of pig carcases is in any quota period exported by a registered carcass exporter to Northern Ireland in contravention of the immediately preceding Article, the exportation of such consignment shall not, for the purposes of this Order, be deemed to be a compliance or a partial compliance with the statutory obligation of such exporter in respect of such quota period.

(3) The exportation to Great Britain by a registered carcase exporter during a quota period of a consignment of pig carcases shall not, for the purposes of this Order, be deemed to be a compliance or partial compliance by such exporter with his statutory obligation in respect of such quota period unless such exporter—

(a) has delivered at the time and place of exportation to the proper officer of customs and excise carcase (export) permits referable to and covering the amount of such consignment, and

(b) has also delivered at the said time and place to the said officer a carcase consignment certificate referable to such consignment and duly completed by such exporter in accordance with the directions set out thereon, and

(c) complies with such other directions in respect of the use of such completed carcase consignment certificate as are set out thereon.

(4) If any registered carcase exporter in any quota period fails to comply with his statutory obligation in respect of such period, the Minister may, unless such exporter has during such period exported at least ninety-five per cent. of his sub-quota in respect of such period, cancel the registration of such exporter in the register of carcase exporters.

17 Revocation of Order.

17. The Pig Carcases (Regulation of Export) Order, 1933, is hereby revoked as on and from the first day of the first quota period fixed by the first quota period order.

18 Recovery of certain expenses by the Minister.

18. Where the Minister incurs expense under section 3 of the Act by reason or in consequence of the failure of any registered bacon exporter, registered pig exporter, or registered carcase exporter to comply with the statutory obligation imposed on such exporter in respect of any quota period, the Minister may recover such expense from such person as a simple contract debt and a certificate under the seal of the Minister certifying that the Minister has incurred expense under the said section 3 by reason or in consequence of the failure of such exporter to comply with the statutory obligation imposed on such exporter in respect of such quota period and certifying the amount of such expense shall be conclusive evidence of the matters so certified.
