THE ROAD TRANSPORT ACT, 1933, (Part II) REGULATIONS ORDER, 1933.

The Road Transport Act, 1933 , (Part II) Regulations Order, 1933, made by the Minister for Industry and Commerce on the 27th day of October, 1933, Pursuant to Section 6 of the Road Transport Act, 1933 .

WHEREAS it is enacted by Section 6 of the Road Transport Act, 1933 , that the Minister for Industry and Commerce may by Order make regulations for prescribing anything which in that Act is referred to as prescribed, and also anything which he is by the said Act authorised to prescribe by regulations made under the Act :

AND WHEREAS it is necessary that regulations should be made for the purposes of Part II of the said Act :

NOW, THEREFORE, the Minister for Industry and Commerce, in the exercise of the powers conferred on him by Section 6 of the Road Transport Act, 1933 , and of all other powers him in this behalf enabling hereby makes the following Regulations for the purposes of Part II of the said Act :

PART I

PRELIMINARY

1. This Order may be cited for all purposes as the Road Transport Act, 1933 , (Part II) Regulations Order, 1933.

2. Words and expressions, defined or established by the Road Transport Act, 1933 , shall have the same meanings where they occur in this Order as in that Act.

3. The Interpretation Act, 1923 , shall apply to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

4. In this Order the expression " the Act " means the Road Transport Act, 1933 .

PART II

MERCHANDISE LICENCES

5. Every application for the grant, renewal, or transfer of a merchandise licence shall be in the appropriate form indicated in the First Schedule hereto, that is to say :—

*Application for the transfer of a merchandise licence Form R.T. 7.

6. Application for the grant of a merchandise licence to commence on the † appointed day shall be lodged not later than the 1st day of December, 1933, or such later date as the Minister may in special circumstances allow.

Application for the grant of a merchandise licence to commence on a date later than the appointed day shall be lodged not later than one calendar month before the proposed date of commencement of the licence, or such shorter period as the Minister may in special circumstances allow.

Application for the renewal of a merchandise licence shall be lodged not later than one calendar month before the date of expiry of the licence, or such shorter period as the Minister may in special circumstances allow.

Application for the transfer of a merchandise licence shall be lodged not later than one calendar month before the proposed date of transfer, or such shorter period as the Minister may in special circumstances allow.

PART III

Vehicle Plates

7. Every application for a vehicle plate shall be in the appropriate form indicated in the Second Schedule hereto, that is to say :—

8. Application for a vehicle plate shall be lodged with the Chief Superintendent of the Gárda Síochána, within whose functional area is situated the vehicle plate-issuing station specified in the applicant's merchandise licence, not later than one week before the date by which the plate is required.

Application for the replacement of a vehicle plate shall be lodged with the Chief Superintendent of the Gárda Síochána, within whose functional area is situated the vehicle plate-issuing station specified in the applicant's merchandise licence, immediately upon the loss, destruction, breakage or defacement of the vehicle plate in respect of which the application is made.

9.—(1) Every vehicle plate shall be of the pattern and bear the words and figures set out in the Third Schedule hereto.

(2) In the space immediately above the words /images/v19p1126.gif there shall be inserted on each plate a serial number consisting of figures not less than one-and-a-quarter inches in height and of a proportionate breadth.

(3) The dimensions and design of the plate shall be as shown in the Third Schedule hereto and there shall be four fixing holes for three-sixteenths of one inch countersunk bolts as shown in the said schedule.

(4) The figures of the aforesaid serial number shall project one-eighth of an inch from the face of the plate, and the remaining words and figures and also the border of the plate shall project one-sixteenth of an inch from the face of the plate.

10. Every vehicle plate shall be securely affixed in an upright position at a minimum height of twenty-four inches from the ground and parallel to the longitudinal axis of the vehicle in respect of which it is issued by means of metal bolts, screws or rivets and in such manner as to be clearly visible by daylight to a person standing at the near side of the vehicle whether such vehicle is moving or stationary.

PART IV

Fees

Merchandise Licences

11. The fee payable to the Minister on application for the grant, renewal, or transfer of a merchandise licence shall be that prescribed in the Fourth Schedule hereto.

Every such fee shall be lodged with the application for the grant, renewal, or transfer of a merchandise licence.

Fees in respect of application for the grant, renewal, or transfer of a merchandise licence shall be payable in the form of a Post Office Money Order payable to the Paymaster General at the General Post Office, Dublin, and crossed " / & Co. / " or in the form of a cheque guaranteed by the bank on which it is drawn, payable to the credit of the Paymaster-General.

Vehicle Plates

12. The fee payable on application to a Chief Superintendent of the Gárda Síochána for a vehicle plate, or for the issue of a new vehicle plate by way of replacement, shall be that prescribed in the Fourth Schedule hereto.

The fee in respect of application for a vehicle plate, or application for the issue of a new vehicle plate by way of replacement, shall be payable by means of a stamp, being the amount of such fee impressedon the application form, and the Stamp Duties Management Act, 1891, shall apply to such fee and such stamp.

13. Every fee collected in respect of merchandise licences and in respect of vehicle plates shall be paid into the Exchequer.

PART V

Accounts and Returns

14.—(1) Every licensee shall keep such full and accurate records as will enable him to prepare the Statement of Accounts and the Financial and Statistical Returns referred to in the next succeeding paragraphs in respect of his entire merchandise road transport business.

(2) Every licensee shall within two months after the 31st December in each year furnish to the Minister a Statement of Accounts, duly audited and certified, and the Financial and Statistical Returns in the respective forms prescribed in Parts I and II of the Fifth Schedule hereto in respect of the year ended on that date or, where a merchandise road transport business was commenced after the 1st January of the year to which the Accounts and Returns relate, in respect of the period dating from the commencement of such business and ending on 31st December of that year.

15. Where the merchandise road transport business to which the Accounts and Returns required by Regulation 14 (2) relate is carried on as part of a larger undertaking, the preparation of the Accounts and Returns prescribed in the Fifth Schedule hereto shall include allocations, as between the merchandise road transport business and the remainder of the said undertaking, of receipts and expenditure (including capital expenditure) and other items common to both on as fair and equitable a basis as possible.

16. Where the merchandise road transport business, to which the Accounts and Returns furnished under Regulation 14 (2) relate, is carried on as part of a larger undertaking the licensee shall furnish to the Minister at the same time:

(i) a brief statement of the character of the said undertaking other than merchandise road transport business carried on by him ;

(ii) a statement showing the allocations made in accordance with Regulation 15 and the basis on which they have been made ;

(iii) all such other information as the Minister may from time to time require as to the compilation of the accounts and returns relating to merchandise road transport or the relation thereof to the licensee's business as a whole;

Provided, however, that no part of the information disclosed under this regulation and not otherwise disclosed shall appear directly in any publication made under the authority of sub-section (3) of Section 28 of the Road Transport Act, 1933 .

(2) In the case of a limited liability company the name and address of the registered office of the company should be given and the application should be signed by a director, secretary or other responsible officer of the company. In the case of a firm, the name by which it is ordinarily known should be given together with the names of the partners and the application should be signed by each of the partners.

(3)and (4) AREAS.

The applicant should describe the area or areas in terms of well defined or well recognised districts, e.g., by counties or as an area within a definite radiusof the principal post office in a town. If this is not done in a satisfactory manner, the licence, if granted, may prove to be valueless to the applicant.

Classes of Merchandise.

It is suggested that the description of the classes of merchandise should be in terms of some such simple classification as is set out hereunder :

Fuels : Peat, Coal, Coke.

Building Materials : Bricks, Tiles, Slates, Cement, Sand, Stone, Timber.

Manures : Artificial Manure, Lime, Stable Manure.

Beet, Grain, etc. : Beet, Grain, Potatoes, Vegetables, Hay, Straw.

Grain Products : Flour, Bran, Cattle Feeding Stuffs, Malt, Seeds.

Livestock : Cattle, Horses, Sheep, Pigs, Fowl, etc.

Miscellaneous Raw Produce : Hides, Skins, Wool, Tar, Salt, Peat Moss Litter, Bog Ore, Clay, Cullet, Paper Pulp.

General Merchandise : Ale, Porter, Whiskey, Wine, Mineral Waters, Machinery, Castings, Iron, Furniture, Paper, Sugar, Bacon, Butter, Oils, Tea, Meat, Tobacco, Fruit, Groceries, Clothing, Farm Implements, and small parcels of a miscellaneous character.

(The particular attention of applicants is directed to the following sections of the Road Transport Act, 1933 :

Section 15. (1) It shall be an obligation on every licensee under a merchandise licence to whom merchandise of a class specified in such licence is offered for carriage between any two places within the area specified in such licence to accept such merchandise for carriage for a reasonable reward between such two places.

(2) If any licensee under a merchandise licence refuses to comply with the obligation imposed on him by this section, such licensee shall, unless he satisfies the court that such refusal was in the circumstances reasonable, be guilty of an offence under this section, and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds.

Section 16. (1) No licensee under a merchandise licence shall, in carrying on the business authorised by such licence, make or give any undue or unreasonable preference or advantage to or in favour of any particular person, trade, industry, district, or port, nor subject any particular person, trade, industry, district or port to any undue or unreasonable prejudice or disadvantage.

(2) Any person, any representative body of traders, or any body of persons representative of a trade or a locality, may, on the ground that there has been a contravention on the part of a licensee under a merchandise licence of the provisions of this section, apply to the railway tribunal for an order enjoining such licensee to desist from such contravention, and upon such application, the railway tribunal may, if satisfied that such contravention has taken place, make such order).

(5) By order dated the 19th day of October, 1933, the Minister appointed certain Gárda Síochána stations to be vehicle plate issuing stations for the purposes of Part II of the Road Transport Act, 1933 . Applicants should refer to this Order before completing this section of the application form. A copy of this Order may be purchased from the Government Publications Sale Office, 5 Nassau Street, Dublin, or through any bookseller.

(6) If the licence is to commence on the appointed day, the words " appointed day " should be inserted. If on any later date, the exact date should be inserted.

In the case of an applicant resident in the Dublin Postal Area, this application form should be presented at the Office of the Revenue Commissioners (Stamps Registry Branch) Dublin Castle, together with the sum of One Pound, being the prescribed fee payable on an application for a vehicle plate. The application form should, when stamped, be presented at the vehicle plate issuing station, as indicated above.

(2) It is provided by Section 30 (4) of the Road Transport Act, 1933 , that a Chief Superintendent of the Gárda Síochána shall not issue a vehicle plate in respect of any mechanically propelled vehicle unless he is satisfied that such vehicle is duly licensed under Section 13 of the Finance Act, 1920, as amended by subsequent enactments.

(3) The signature should correspond with the name of the licensee as shown in the merchandise licence, and in the case of a limited liability company should be authenticated by the signature of a director, secretary, or other responsible officer of the company.

(4) Applicant should clearly describe the type of vehicle, e.g., " motor lorry, " " motor tractor," " steam lorry," " steam tractor."

(1) Where a Merchandise Road Transport business was commenced after the 1st January of the year to which this return relates, the information required is for so much of the year as the business was in existence.

(2) Proportion or whole, as the case may be, of the salaries of the superintendent or other officers (if any) under whose supervision the maintenance of the buildings is carried out to be included under the head of superintendence.

Wages of the Licensee's employees (if any), i.e., tradesmen and labourers engaged on the maintenance of buildings, and materials and used thereon, be to charged to maintenance.

Where work is carried out by a contractor, the total cost to be included opposite the maintenance heading.

(3) Salaries of works managers, superintendents, overseers, foremen &c. solely engaged in supervising construction and maintenance of Lorries or Tractors, be to charged to superintendence. Wages of mechanics, tradesmen and labourers engaged on repairs or renewals of Lorries or Tractors, with materials used, to be charged to the respective relevant items shown under this head.

In the case of renewals of vehicles on hire-purchase system, the instalments of principal accrued during the year should be charged under the head of Lorries or Tractor as the case may be. Vehicles which represent additions to stock and not existing stock should be dealt with in capital account and not under this head.

(4) Salaries of traffic manager and superintendents to be included under the head of superintendence. Wages, including allowances of goods clerks, traffic inspectors, foremen, drivers, &c., to be shown under the head of Wages.

(5) Telephone rent, messengers' and office cleaners' wages, stationery, fire, lighting, &c., to be charged to office expenses.

(6) Comparative figures for the corresponding period of previous year to be given in these columns.
