THE OLD AGE PENSIONS COMMITTEES (CLERKS) ORDER, 1932.

THE OLD AGE PENSIONS COMMITTEES (CLERKS) ORDER, 1932.

WHEREAS by section 8 of the Old Age Pensions Act, 1932 , every local pensions committee and every sub-committee appointed by a local pensions committee under section 8 of the Old Age Pensions Act, 1908, is declared to be a local authority for the purpose of section 15 of the Local Government (Temporary Provisions) Act, 1923 :

AND WHEREAS by Article 23 of the Old Age Pensions Consolidated Regulations, 1922, every local pensions committee and every sub-committee appointed by such first-mentioned committee is required to appoint a fit person to be clerk of such committee or sub-committee as the case may be:

AND WHEREAS in pursuance of section 15 of the Local Government (Temporary Provisions) Act, 1923 , the Minister for Local Government did by the Local Offices and Employments Order, 1924, apply the said section to the offices and employments set forth in the Schedule to the said Order:

AND WHEREAS in pursuance of section 15 of the Local Government (Temporary Provisions) Act, 1923 , the Minister for Local Government and Public Health did by the Local Offices and Employments (Gaeltacht) Orders, 1928 to 1932, regulate the continuance in office of persons appointed to the offices or employments set forth in the First Schedule thereto, the duties of whom were to be performed in or in relation to the Gaeltacht or any portion thereof as defined in the said Orders:

AND WHEREAS the office of clerk of a local pensions committee is an office to which section 15 of the Local Government (Temporary Provisions) Act, 1923 , has been applied by the said Local Offices and Employments Order, 1924, and the continuance in which is regulated by the said Local Offices and Employments (Gaeltacht) Orders, 1928 to 1932:

AND WHEREAS it is expedient to make the regulations hereinafter appearing with respect to the offices of clerk of a local pensions committee and clerk of a sub-committee appointed by any such committee:

NOW, THEREFORE, the Minister for Local Government and Public Health, in exercise of the powers vested in him by section 15 of the Local Government (Temporary Provisions) Act, 1923 , as extended by section 8 of the Old Age Pensions Act, 1932 , does by this his Order, prescribe and order as follows, that is to say :—

1. This Order may be cited as the Old Age Pensions Committees (Clerks) Order, 1932, and shall come into operation on the 30th day of September, 1932.

2. In this Order—

the expression "the Minister" means the Minister for Local Government and Public Health ;

the expression "local pensions committee" means a local pensions committee appointed under section 8 of the Old Age Pensions Act, 1908 ;

the expression "local pensions sub-committee" means a sub-committee appointed by a local pensions committee.

3.—(1) The Minister hereby prescribes the following offices to be offices to which section 15 of the Local Government (Temporary Provisions) Act, 1923 , shall apply, namely—

(a) the office of clerk of a local pensions committee; and

(b) the office of clerk of a local pensions sub-committee.

(2) The provisions of the Local Offices and Employments Order, 1924, as amended by any subsequent order of the Minister, and of the Local Offices and Employments (Gaeltacht) Orders, 1928 to 1932, shall, save as hereinafter provided, cease to apply to the office of clerk of a local pensions committee.

4.—(1) Every appointment of a person as clerk of a local pensions committee, being an office to which the Local Authorities (Officers and Employees) Act, 1926 , applies, or as clerk of a local pensions sub-committee, shall be forthwith reported to the Minister by the committee or sub-committee, as the case may be.

(2) Every appointment of a person to be clerk of a local pensions sub-committee shall be subject to the approval of the Minister.

5. No person shall be appointed to the office of clerk of a local pensions sub-committee unless an advertisement specifying the day fixed for such appointment shall, by direction of such sub-committee, have been inserted in some newspaper or newspapers circulating in their district at least seven days before the day so fixed.

6.—(1) The provisions of the Local Offices and Employments (Gaeltacht) Orders, 1928 to 1932, shall, notwithstanding anything contained in this Order, continue to apply to any person holding the office of clerk of a local pensions committee immediately before the coming into operation of this Order, whose continuance in office is regulated by the said Orders, in like manner as if this Order had not been made.

(2) The provisions of the Local Offices and Employments (Gaeltacht) Orders, 1928 to 1932, shall apply for the purpose of regulating the continuance in office of any person who may on or after the coming into operation of this Order be appointed to the office of clerk of a local pensions committee or clerk of a local pensions sub-committee, and whose total annual remuneration amounts to Forty Pounds or more, in the like manner as the said Orders apply to persons appointed to offices or employments to which the said Orders apply.

7. Subject to the provisions of the Local Offices and Employments (Gaeltacht) Orders, 1928 to 1932, as applied by this Order, every person holding the office of clerk of a local pensions committee or clerk of a local pensions sub-committee shall hold office until he die or resign or be removed by the Minister or by the local pensions committee or sub-committee, as the case may be, with the consent of the Minister.
