STATUTORY RULES AND ORDERS. 1930. No. 69.

SCHOOL ATTENDANCE (CORK CITY SCHOOL ATTENDANCE COMMITTEE) ORDER, 1930.

WHEREAS by virtue of sub-section (8) of Section 10 of the School Attendance Act, 1926 (No. 17 of 1926), the Minister for Education, after consultation with the Minister for Local Government and Public Health, is empowered by order to prescribe (amongst other things) the time and mode of appointment of members of the school attendance committee for the school attendance area which is the county borough of Cork by the council of such county borough and by the Minister respectively, and the time of commencement of the period of office of the members of such committee,

AND WHEREAS the Minister for Education has, before making this Order, consulted with the Minister for Local Government and Public Health,

NOW, the Minister for Education, in exercise of the powers conferred on him by sub-section (8) of Section 10 of the School Attendance Act, 1926 (No. 17 of 1926), and of every other power him in this behalf enabling hereby orders as follows :—

1. This Order may be cited as the Cork City School Attendance Committee Order, 1930.

2. The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In this Order :

the expression "the Minister" means the Minister for Education ;

the expression " the Act " means the School Attendance Act, 1926 (No. 17 of 1926) ;

the expression " election year " means the year 1930 or any ensuing third successive year ;

the expression " quarterly meeting " has the same meaning as in the Local Government (Ireland) Act, 1898 ;

the expression " the Cork City school attendance committee " means the school attendance committee for the school attendance area which is the county borough of Cork.

4. The following provisions shall have effect in relation to the time and mode of appointment of members of the Cork City school attendance committee by the council of the county borough of Cork and the Minister respectively, that is to say :

(a) The council of the county borough of Cork shall in every election year elect at the quarterly meeting of such council held last before the 31st day of October in that year,such number of members of the Cork City school attendance committee as such council is entitled under the Act so to elect, and such election shall be included in the business to be transacted at such quarterly meeting of such council ;

(b) The Town Clerk of the county borough of Cork shall immediately after every election held in pursuance of the foregoing sub-paragraph send to the Minister the names, addresses and descriptions of the persons elected at such election ;

(c) The Minister shall in every election year before the 31st day of December in such year nominate five persons to be members of the Cork City school attendance committee.

5. The term of office of members (other than members appointed to fill casual vacancies) of the Cork City school attendance committee appointed in an election year shall commence on the 1st day of January in the year next following such election year.
