STATUTORY RULES AND ORDERS. 1930. No. 32.

CENSORSHIP OF PUBLICATIONS REGULATIONS, 1930.

I, JAMES FITZGERALD-KENNEY, Minister for Justice, in exercise of the powers vested in me by Section 20 of the Censorship of Publications Act, 1929 , and of each and every power me in this behalf enabling do hereby make the following regulations :—

1.—These regulations may be cited as the Censorship of Publications Regulations, 1930.

2.—The Interpretation Act, 1923 , applies to these regulations in the same manner as it applies to an Act of the Oireachtas.

3.— (1) Complaints made under Section 6 of the Act shall be in Form A. in the Schedule hereto or such modification thereof as may be suitable.

(2) When the complaint relates to a book published at a price not exceeding three shillings and sixpence, three copies of the book shall be furnished with the complaint.

(3) When the complaint relates to a book published at a price exceeding three shillings and sixpence, and not exceeding seven shillings and sixpence, two copies of the book shall be furnished with the complaint.

(4) When the complaint relates to a book published at a price exceeding seven shillings and sixpence, one copy of the book shall be furnished with the complaint.

4.— (1) Complaints made under Section 7 of the Act shall be in Form B. in the Schedule hereto or in such modification thereof as may be suitable.

(2) Complaints made under Section 7 shall be accompanied by copies of not less than three recent issues of the periodical publication complained of.

(3) When the complaint relates to a periodical publication published at a price not exceeding sixpence, six copies of each issue shall be furnished with the complaint.

(4) When the complaint relates to a periodical publication published at a price exceeding sixpence, three copies of each issue shall be furnished with the complaint.

5.—Reports made by the Censorship of Publications Board in respect of complaints referred to them by the Minister under Sections 6 and 7 of the Act, shall be in Form C. in the Schedule hereto or in such modification thereof as may be suitable.

6.—Reports made by the Censorship of Publications Board on their own initiative under Section 6 sub-section 5 of the Act shall be in Form D. in the Schedule hereto or in such modification thereof as may be suitable.

7.—The " Register of Prohibited Publications " shall be in two parts, one relating to books and the other to periodical publications.

8.—The Register of Prohibited Publications (Books) shall be in Form D. in the Schedule hereto.

9.—The Register of Prohibited Publications (Periodical Publications) shall be in Form E. in the Schedule hereto.

10.—The Register of Prohibited Publications shall be open to inspection, free of charge, by any person at the office of the Minister for Justice, between the hours of 11 o'clock in the morning and 4 o'clock in the afternoon on every week-day (other than a Saturday or a public holiday).

COMPLAINT REGARDING A BOOK.

To The Minister for Justice.

(a) indecent or obscene ;

(b) advocates the unnatural prevention of conception or the procurement of abortion or miscarriage or the use of any method, treatment or appliance for the purpose of such prevention or such miscarriage.

I refer particularly to the passages marked on pages.......... in support of my view and I have the following comments to make on the general tendency of the book as regards indecency or obscenity.

(1) When the complaint relates to a book published at a price not exceeding three shillings and sixpence, three copies of the book shall be furnished with the complaint.

(2) When the complaint relates to a book published at a price exceeding three shillings and sixpence and not exceeding seven shillings and sixpence ; two copies of the book shall be furnished with the complaint.

(3) When the complaint relates to a book published at a price exceeding seven shillings and sixpence, one copy of the book shall be furnished with the complaint.

CENSORSHIP OF PUBLICATIONS ACT, 1929 .

COMPLAINT REGARDING A PERIODICAL PUBLICATION.

To the Minister for Justice.

I, (insert name and address) hereby complain that the several issues of (insert name of Periodical) recently published have

(a) usually or frequently been indecent or obscene;

(b) advocated the unnatural prevention of conception or the procurement of abortion or miscarriage or the use of any method, treatment or appliance for the purpose of such prevention or such procurement ;

(c) devoted an unduly large proportion of space to the publication of matter relating to crime.

I enclose (insert number) copies of each of the issues of the said publication published on (insert dates).

NOTE.—(1) Copies of not less than three different issues of the periodical must be furnished with the complaint.

(2) In the case of Dailies, the issues should have been published within 14 days of the date of the complaint ; in the case of Weekly Periodicals, within six weeks ; and in the case of Monthly Periodicals, within six months.

(3) When the complaint relates to a periodical published at a price not exceeding sixpence, six copies of each issue must be furnished with the complaint.

(4) When the complaint relates to a periodical published at a price exceeding sixpence, three copies of each issue must be furnished with the complaint.

REPORT OF THE CENSORSHIP OF PUBLICATIONS BOARD.

To the Minister for Justice.
