BY-LAW No. 388.No. 8 or LIMERICK DISTRICT.

LOUGHS ENNELL, OWEL AND DERRAVARAGH.

I, FIONÁN O LOÍNGSIGH, Minister for Fisheries, by virtue and in exercise of the powers vested in me by the Fisheries Act, 1925 , and of every other power enabling me in this behalf, do MAKE AND ORDAIN THE FOLLOWING BY-LAW :—

(1) It is prohibited to take or capture by any means whatsoever in Lough Ennell, Lough Owel or Lough Derravaragh, in the County of Westmeath, or in any of the tributary streams flowing into the said lakes or any of the lakes situated on such tributary streams any fish of the salmon or trout kind of less size than seven inches in length, measured in a straight line from the tip of the snout to the fork of the tail, or to have in possession in or on or near the banks of the said lakes or streams any fish of less than the said size.

(2) Any such fish which may be taken or captured must be returned alive to the water forthwith.

(3) This By-Law shall not apply to the taking, capture or possession of fish under authority given in accordance with Section 32 of the Fisheries Act, 1925 , nor to the possession of fish in any hatchery or private pond.

(4) Each and every person offending against this By-law shall forfeit and pay for each offence a sum not exceeding five pounds, and every net used or found contrary to this By-law shall be forfeited.

(5) The Interpretation Act, 1923 , (No. 46 of 1923) applies to the interpretation of this By-law in like manner as it applies to the interpretation of an Act of the Oireachtas.

(6) This By-law may be cited for all purposes as the Westmeath Lakes Size-limit By-law, No. 388, 1928.

NOTE A:—Under the provisions of the Fisheries Act, 1925 , this by-law will come into operation on the twenty-eighth day after the above date.
