BY-LAW No. 387No. 8 or LIMERICK DISTRICT.

LOUGHS ENNELL AND DERRAVARAGH.

I, FIONÁN O LOÍNGSIGH, Minister for Fisheries, by virtue and in exercise of the powers vested in me by the Fisheries Act, 1925 , and of every other power enabling me in this behalf, do MAKE AND ORDAIN THE FOLLOWING BY-LAW :—

(1) It is prohibited to use between sunset and sunrise any net for the purpose of taking or with intent to take fish in Lough Ennell or Lough Derravaragh, in the County of Westmeath, save landing nets used solely as auxiliary to fishing legally with rod and line.

(2) It is prohibited to use between sunrise and sunset in the said Lough Ennell or Lough Derravaragh any net for the purpose of taking or with intent to take fish save (a) landing nets used solely as auxiliary to fishing legally with rod and line, (b) drum nets for the capture of fish other than salmon or trout, and (c) nets with a mesh of not less than 2¼ inches square or 9 inches in the round, measured in the clear when the net is wet, and mounted without a foot-rope.

(3) It is prohibited to put, leave or have in possession in or on the banks of the said lakes any net, mounted and capable of being used for fishing, of which the use would not be lawful at the time.

(4) The By-laws numbered 1 and 2 made on the 3rd December, 1909, relating to the use of nets on the said Loughs Ennell and Derravaragh, are hereby revoked.

(5) Each and every person offending against this By-law shall forfeit and pay for each offence a sum not exceeding five pounds ; and every net used or found contrary to this By-law shall be forfeited.

(6) The Interpretation Act, 1923 , (No. 46 of 1923) applies to the interpretation of this By-law in like manner as it applies to the interpretation of an Act of the Oireachtas.

(7) This By-law may be cited for all purposes as the Loughs Ennell and Derravaragh By-law, No. 387, 1928.

NOTE A:—Under the provisions of the Fisheries Act, 1925 , this By-Law will come into operation on the twenty-eighth day after the above date.
