STATUTORY RULES AND ORDERS. 1928. No. 43.

THE BLESSINGTON & POULA-PHOUCA STEAM TRAMWAY COMPANY (CESSER OF POWERS) ORDER. 1928.

WHEREAS the Blessington and Poula-Phouca Steam Tramway Company (hereinafter referred to as the Company) was authorised by the Blessington and Poula-Phouca Steam Tramway Order, 1889 to make, maintain and work the Tramway referred to in the said Order subject to and in accordance with the provisions thereof.

AND WHEREAS it is provided amongst other things by paragraph 37 of the said Order that if at any time after opening the said Tramway for public traffic the Company shall discontinue the working thereof for three months (such discontinuance not being occasioned by circumstances beyond the control of the Company, for which purpose the want of sufficient funds shall not be considered a circumstance beyond their control), and such discontinuance is proved to the satisfaction of the Board of Trade, the said Board may, by Order, declare that the powers of the Company in respect of the said Tramway shall from the date of such Order be at an end, and thereupon the said powers of the Company shall cease and determine,

AND WHEREAS by virtue of the provisions of section 2 of the Ministry of Transport Act, 1919 and of the Ministry of Transport (Board of Trade Exception of Powers) Order, 1919 made under the said section 2 and the provisions of the Ministers and Secretaries Act, 1924 (No. 16 of 1924) the powers of the Board of Trade under paragraph 37 of the Blessington and Poula-Phouca Steam Tramway Order, 1889 are now vested in the Minister for Industry and Commerce,

AND WHEREAS the said Tramway having been opened for public traffic the Company has for want of sufficient funds (a circumstance not beyond the control of the Company) discontinued the working thereof for three months and such discontinuance has been proved to my satisfaction.

NOW, THEREFORE, I, PATRICK McGILLIGAN, Minister for Industry and Commerce, by virtue of the powers conferred by paragraph 37 of the Blessington and Poula-Phouca Steam Tramway Order, 1889 and now vested in me and of every and any other power enabling me in this behalf do hereby order as follows :—

1. This Order may be cited for all purposes as the Blessington and Poula-Phouca Steam Tramway Company (Cesser of Powers) Order, 1928.

2. The powers of the Blessington and Poula-Phouca Steam Tramway Company in respect of the Tramway referred to in the Blessington and Poula-Phouca Steam Tramway Order, 1889 shall be at an end as from the date of this Order.
