STATUTORY RULES AND ORDERS. 1928. No. 7.

THE ASSURANCE COMPANIES ACT, 1909, ADAPTATION ORDER, 1928.

WHEREAS it is enacted by section 12 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), that the Executive Council of Saorstát Eireann may from time to time by order make all such general or specific adaptations of or modifications in any British Statute which in the opinion of the Executive Council are necessary in order to enable such Statute to have full force and effect in Saorstát Eireann :

AND WHEREAS in the opinion of the Executive Council the adaptations intended to be made by this order of the Assurance Companies Act, 1909 (being a British Statute within the meaning of the said Adaptation of Enactments Act, 1922 ), are necessary in order to enable that Statute to have full force and effect in Saorstát Eireann :

NOW, the Executive Council of Saorstát Eireann, in exercise of the power in this behalf conferred on them by section 12 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), and of every and any other power them in this behalf enabling, do hereby order as follows :—

1. This Order may be cited for all purposes as the Assurance Companies Act, 1909, Adaptation Order, 1928.

2. The Interpretation Act, 1889, applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas passed before the 1st day of January, 1924.

3. (1) The references to the United Kingdom contained in the provisions of the Assurance Companies Act, 1909, to which this paragraph applies shall be construed as references to Saorstát Eireann, and the said Act shall have effect accordingly.

(2) This paragraph applies to the following provisions of the said Assurance Companies Act, 1909, that is to say :—

(i) Sections 1 and 19,

(ii) Paragraph (b) of section 31,

(iii) Paragraph (b) or section 32,

(iv) Paragraphs (d) and (i) of section 33,

(v) Paragraph (b) of section 34, and

(vi) Forms (A) and (D) of the First Schedule.

4. The references to the Paymaster-General contained in paragraph (e) of section 33 and paragraph (c) of section 34 of the Assurance Companies Act, 1909, shall be construed as references to the Accountant of the Courts of Justice, and the said Act shall have effect accordingly.

5. In the Third Schedule to the Assurance Companies Act, 1909:

(a) the reference contained therein to mortgages on property within the United Kingdom shall be construed as a reference to mortgages on property within Saorstát Eireann.

(b) the reference contained therein to mortgages on property out of the United Kingdom shall be construed as a reference to mortgages on property out of Saorstát Eireann, and

(c) the reference contained in Note 1 thereto to the United Kingdom shall be construed as a reference to Saorstát Eireann,

and the said Act shall have effect accordingly.

6. The reference to the United Kingdom contained in Note 3 to the Form entitled " Summary and Valuation of the Policies of the ........................... as at ................... 19 .." set out in the Fourth Schedule to the Assurance Companies Act, 1909, shall be construed as a reference to Saorstát Eireann, Great Britain and Northern Ireland, and the said Act shall have effect accordingly.
