STATUTORY RULES AND ORDERS. 1927. No. 97.

THE GENERAL CATTLE DISEASES FUND (CATTLE PLEURO-PNEUMONIA ACCOUNT) (APPORTIONMENT) ORDER, 1927.

WHEREAS it is enacted by Section 9 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922) that whenever under any British Statute any grant whether capital or annual is directed or authorised to be made by the Treasury out of the Consolidated Fund or by the Treasury or any other Government Department out of any other Fund and the maximum limit of such grant is by such Statute fixed either for the whole of the late United Kingdom or for any part thereof which included the area now comprised in Saorstát Eireann, the Minister for Finance may by order apportion such limit between Saorstát Eireann and the rest of the area in respect of which such limit is fixed as aforesaid and may by such order fix the maximum limit of such grant to be made under such Statute in Saorstát Eireann :

AND WHEREAS it is enacted by sub-paragraph (a) of paragraph (1) of Section 73 of the British Statute entitled the Diseases of Animals Act, 1894 that there shall be paid to the General Cattle Diseases Fund such moneys (not exceeding twenty thousand pounds in any one year) as may be provided by Parliament towards defraying the costs incurred by the Lord Lieutenant and Privy Council in the execution of the provisions of that Act relating to the slaughter of cattle, animals, or swine on account of pleuro-pneumonia, foot and mouth disease, or swine fever, and that the moneys so paid shall be carried to the Cattle Pleuro-pneumonia Account for Ireland :

AND WHEREAS it is enacted by paragraph (2) of the said Section 73 of the British Statute aforesaid that of the money provided by Parliament for the Cattle Pleuro-pneumonia Accounts of Great Britain and Ireland not more than fifty thousand pounds shall be so provided for the costs of the execution of that Act as respects swine fever in any one year :

AND WHEREAS the said maximum limit of twenty thousand pounds was fixed by the British Statute aforesaid for the whole of Ireland being part of the late United Kingdom which included the area now comprised in Saorstát Eireann and the said maximum limit of fifty thousand pounds was fixed by such British Statute for the whole of the late United Kingdom, and it is necessary that the said maximum limits should be apportioned between Saorstát Eireann and the rest of the areas in respect of which they were so fixed respectively and that the maximum limits of the grants to be made under such British Statute should be fixed :

NOW the Minister for Finance, in exercise of the power conferred on him by Section 9 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922) and of every and any other power him in this behalf enabling doth hereby order as follows :—

1. This Order may be cited for all purposes as the General Cattle Diseases Fund (Cattle Pleuro-pneumonia Account) Apportionment) Order, 1927.

2. In this Order the expression " the Act " means the Diseases of Animals Act, 1894.

3. The Interpretation Act, 1889 applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas passed before the 1st day of January, 1924.

4. The maximum limit of £20,000 (twenty thousand pounds) fixed by sub-paragraph (a) of paragraph (1) of Section 73 of the Act is hereby apportioned between Saorstát Eireann and the rest of the area in respect of which the said sum was so fixed as follows, that is to say:—

(a) in respect of Saorstát Eireann the sum of £15,000 (fifteen thousand pounds), and

(b) in respect of the rest of the area aforesaid the sum of £5,000 (five thousand pounds).

5. The maximum limit of the grant which may be made in Saorstát Eireann in any one year under sub-paragraph (a) of paragraph (1) of the Diseases of Animals Act, 1894 shall be the sum of £15,000 (fifteen thousand pounds).

6. The maximum limit of £50,000 (fifty thousand pounds) fixed by paragraph (2) of the Act is hereby apportioned between Saorstát Eireann and the rest of the area in respect of which the said sum was so fixed as follows, that is to say :—

(a) in respect of Saorstát Eireann the sum of £10,000 (ten thousand pounds), and

(b) in respect of the rest of the area aforesaid, the sum of £40,000 (forty thousand pounds).

7. The maximum limit of the grant which may be made in Saorstát Eireann in any one year for the Cattle Pleuro-pneumonia Account for the costs of the execution of the Act as respects swine fever shall be £10,000 (ten thousand pounds).
