22/10/1926: Fishery By-Laws No. 379 and No. 380. Tralee Bay Oyster Fisheries.


DEPARTMENT OF FISHERIES FISHERIES ACTS 1842 TO 1925. ____________________________

BY-LAWS No. 379 and No. 380.TRALEE BAY OYSTER FISHERIES.

I, FIONAN O'LOINGSIGH, Minister for Fisheries, by virtue and in exercise of the powers vested in me by the Fisheries Act, 1925 , and of every other power enabling me in this behalf, do MAKE AND ORDAIN THE FOLLOWING BY-LAWS :—

No. 379.

(1) The period appointed by the By-law dated the 4th November, 1912, for the close time of the Oyster Fisheries on the public or natural oyster beds which are situated in Tralee Bay or the bays or inlets thereof or on the shores or rocks thereof shall cease ; and there shall be kept and observed in lieu thereof as the close time of such fisheries the period from the First day of April to the Thirtieth day of September in each year, both said days inclusive.

(2) This By-law may be cited for all purposes as the Tralee Bay Oysters Close Season By-law, No. 379, 1926.

(3) This By-law shall come into operation on the Twenty-eighth day of February, 1927.

No. 380.

(1) It shall not be lawful during the month of March or the month of October in any year for any person to remove by any means whatsoever, save by dredging, any oysters from any of the public or natural oyster beds which are situated in Tralee Bay or the bays or inlets thereof or on the shores or rocks thereof.

(2) The By-law dated the 4th November, 1912, whereby it was prohibited during the month of October in any year to remove by any means whatsoever, save by dredging, any oysters from the aforesaid oyster beds is hereby revoked.

(3) Each and every person offending against this By-law shall forfeit and pay for each offence a sum not exceeding Five Pounds.

(4) This By-law may be cited for all purposes as the Tralee Bay Oysters By-law No. 380, 1926.

(5) This By-law shall come into operation on the Twenty-eighth day of February, 1927.

NOTE.—Under Section 36 of the Fisheries (Ireland) Act, 1842, the penalty for a breach of the close season for oysters is a fine not exceeding Five Pounds and forfeiture of any oysters taken.
