THE SCHOOL ATTENDANCE (STATUTORY FORMS) ORDER, 1926.

WHEREAS by section 23 of the School Attendance Act, 1926 (No. 17 of 1926), it is enacted that the Minister for Education may by order prescribe any matter or thing which is in that Act referred to as prescribed or to be prescribed :

AND WHEREAS the several forms intended to be prescribed by this Order are in the said Act referred to as prescribed forms :

NOW I, JOHN MARCUS O'SULLIVAN, Minister for Education, in exercise of the power conferred on me by the School Attendance Act, 1926 (No. 17 of 1926), and of every and any other power me in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the School Attendance (Statutory Forms) Order, 1926.

2. In this Order, the expression " the Act " means the School Attendance Act, 1926 (No. 17 of 1926), and the expression, " the Minister " means the Minister for Education.

3. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

4. The certificate mentioned in sub-section (1) of section 5 of the act certifying any particular school to be a suitable school within the meaning of the Act for the attendance of children to whom the Act applies for the purpose of receiving elementary education shall be in the Form No. 1 in the Schedule hereto.

5. Every appointment of a school attendance officer made by a school attendance committee under sub-section (1) of section 12 of the act shall be in the Form No. 2 in the Schedule hereto.

6. The warning to a parent mentioned in sub-section (1) of section 17 of the act shall be in the Form No. 3 in the Schedule hereto.

7. The requisition given to any person under sub-section (2) of section 19 of the act by the enforcing authority of the school attendance area in which a child resides for a certificate of the date of the birth of such child shall be in the Form No. 4 of the Schedule hereto.

8. The notice mentioned in section 20 of the act to a person to furnish particulars of the children of whom he is the parent shall, when such notice relates to all such children, be in the Form No. 5 in the Schedule hereto and, when such notice relates to a specified child, be in the Form No. 6 in the Schedule hereto.

Now you are hereby required within one week after the service of this notice upon you either to cause the said child,................................, to attend school in accordance with the said School Attendance Act, 1926 , or to furnish to me at the address given below a reasonable excuse for not so doing.

In the event of your failing to comply with this Warning, proceedings will be instituted against you under the said School Attendance Act, 1926 , in the District Court, and if, within three months after such proceedings, you again fail to comply with the said Act, further proceedings may be instituted against you under the said Act without previous warning.

INSTRUCTIONS FOR COMPLETING THE ABOVE SCHEDULE.

1. Insert in column 1 the Christian names and surname of every child of yours who is under the age of sixteen years on the......day of..............192.., and is on that day either living with you or in your actual custody, but living at a school or elsewhere.

2. Also insert in column 1 the Christian names and surname of any child (not being a child of yours) who on the......day of....................192..is under the age of sixteen years, and is on that day in your legal guardianship or living with you or in your actual custody, but living at a school or elsewhere.

3. Insert in column 2, opposite the name of each child entered in column 1, the age of the child on the......day of....................192.., and insert in column 3 the date (giving the day, month, and year) of his or her birth.

4. Insert in column 4, opposite the name of each child entered in column 1, the name and address of the school which the child is attending, or if the child is not attending any school, state in the said column 3 how the child is being educated, or, if the child is not being educated at all, state in the said column 3 the reason why the child is not being educated.

5. Insert in column 5, opposite the name of each child entered in column 1, the information asked for at the head of the said column 5.

6. Note that columns 4 and 5 need not be filled up in regard to any child who on the......day of....................19....is under six years of age or is fourteen years of age or upwards.

7. When you have filled in the Schedule according to these instructions, you must sign and date it, and leave it with or send it by post to the School Attendance Officer at the address named at the foot of this notice.

INSTRUCTIONS FOR FILLING UP THE ABOVE SCHEDULE.

1. State at No. 1 the full christian names and surname of the child named in this Notice.

2. State at No. 2 the present age of the said child, and state at No. 3 the date (giving the day, month, and year) on which he or she was born.

3. State at No. 4 the name and address of the school which the said child is attending, or, if the said child is not attending any school, state how he or she is being educated, or, if the said child is not being educated at all, state why he or she is not being educated.

4. State at No. 5 the information there asked for.

5. Note that you need not fill up Nos. 4 and 5 if the said child is under six years of age, or is fourteen years of age or upwards.

6. Note also that for the purposes of the School Attendcnce Act, 1926, a parent includes a legal guardian and any person who has the actual custody of a child or with whom the child is living.

7. When you have filled up the Schedule you must sign and date it and leave it with or send it by post to the School Attendance Officer named at the foot of this Notice.
