DISTRICT COURT (AREAS) ORDER 1926.
|
| |
WHEREAS it is enacted by section 47, sub-section (1) of the
Court Officers Act, 1926
(No. 27 of 1926) that the Minister for Justice shall divide every district prescribed by him under
section 68
of the
Courts of Justice Act, 1924
(No. 10 of 1924) into such and so many convenient areas (to be called District Court Areas) as he shall think proper and may divide any such district into different district court areas for the purposes of different classes of business transacted in the District Court.

AND WHEREAS it is enacted by sub-section (2) of the said section that the Minister for Justice shall appoint one or more convenient places in every district court area or within one mile of the boundary of such area in which, and such and so many convenient days and hours at which, the District Court shall be held for the purpose of transacting for such district court area the business for the transaction of which such area was delimited,

AND WHEREAS it is enacted amongst other things by sub-section (3) of the said section that it shall be lawful for the Minister for Justice from time to time as he shall think expedient, to vary any district prescribed by him under the said
section 68
of the
Courts of Justice Act, 1924
.

AND WHEREAS certain of the Districts so prescribed have been varied by the District Court (Districts) Order, 1926,
|
| |
AND WHEREAS it is expedient that the said districts as so prescribed and varied shall be divided in the manner following and that the courts shall be held at the places and times, and for the classes of business hereinafter mentioned,

NOW, I, CAOIMHGHIN O HUIGIN, Minister for Justice, in exercise of the powers conferred on me by sub-sections (1) and (2) of
section 47
of the
Court Officers Act, 1926
(No. 27 of 1926) and of every and any other power me in this behalf enabling do hereby order as follows, that is to say,

(1) This Order may be cited for all purposes as the District Court (Areas) Order, 1926 and shall come into operation on the 1st day of October, 1926;
|
| |
(2) The
Interpretation Act, 1923
(No. 46 of 1923) shall apply to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas;
|
| |
(3) For the purposes of civil proceedings in the District Court as defined by Rule 2 of the District Court Rules the districts so prescribed and varied as aforesaid shall be divided into the district court areas, and the District Court shall be held at the places and times set forth in Part I of the Schedule to this Order;
|
| |
(4) For the purposes of cases of summary jurisdiction as defined by Rule 2 of the District Court Rules and of the preliminary investigation of indictable offences the districts so prescribed and varied as aforesaid shall be divided into the district court areas and the Court shall be held at the places and times set forth in Part II of the Schedule to this Order.

Boundary.—The District was defined and extended under the provisions of the Acts 1 Vic., cap. 25, and 2 & 3 Vic., cap. 78, sec. 14, 63 & 64 Vic., cap. 264, sec. 61, and Order in Council dated 23rd October, 1901. It now comprises the City of Dublin, and part of the County of Dublin, bounded as follows:—

From the Lighthouse on the North Wall of the River Liffey, by a direct line to the Lighthouse at the end of the South Wall; thence by low-water mark and the sea shore to a point two furlongs beyond the Southern Wall of Mount Malpas, Killiney, and from said point by a line running two furlongs distance from said Wall to the entrance gate of said Mount; thence by a line at the like distance to the left or outside of the Glenageary and Rochestown roads, leading to Kill-of-the-Grange; thence at like distance by the cross road of Dean's-grange and Stillorgan-road, to a point on the left bank of the River Dodder two furlongs southward of Donnybrook Bridge; thence by the left bank of that river to the junction of the baronies of Newcastle and Uppercross, near Cypress-grove, and by the boundary of those baronies to the third lock on the Grand Canal, near Golden-bridge; thence by a direct line, drawn through the fields from said lock to Chapelizod-bridge on the River Liffey, to a point 50 perches from said lock where said line intersects the boundary between the parishes of St. Jude and Ballyfermott, and by said boundary to where it intersects the G. S. & W. All the lands, sands, foreshore and sloblands specified in the said Local Government Board (Ireland) Provisional Order Confirmation (No. 1) Act, 1916, between the existing City Boundary and a straight line drawn in a north-easterly direction from the junction of the existing City Boundary and the toe of the Great Northern Railway embankment on its north-western side parallel to the toe of the embankment to its north-western corner proceeding thence in an easterly direction along the face of the embankment wall to its north-eastern corner, thence in a south-westerly direction parallel to the toe of the embankment on its south-eastern side to a point 150 feet distant (measured at right angles) from the southern toe of the existing sea wall along the Coast Road, thence in a sinuous line every point of which is 150 feet from the said toe of the sea wall until the said line reaches the south-west side of the Bull Wall, and thence along the south-west side of the Bull Wall in a north-westerly direction to the junction of the Bull Wall with the Coast Road; and also all that portion of the foreshore and estuary of the River Liffey inclosed by the existing City Boundary and a line running in an easterly direction from the junction of the existing City Boundary and the reclaimed land the property of the Port and Docks Board along the northern face of the north breakwater to its north-eastern corner, thence along the eastern face of the east breakwater to its southern extremity, thence in a westerly direction to a point on the existing City Boundary in line with the southern face of the North Quay Extension Wall.
