STATUTORY RULES AND ORDERS. 1926. No. 21.

OIL IN NAVIGABLE WATERS (RECORDS) ORDER, 1926.

The Oil in Navigable Waters (Records) Order, 1926, made by the Minister for Industry and Commerce under Section 6 of the Oil in Navigable Waters Act, 1926 (Number 5 of 1926).

WHEREAS Section 6 of the Oil in Navigable Waters Act, 1926 , provides that there shall be kept in respect of every vessel, as defined in the said Act, to or from which any oil is transferred, a record, in such form as the Minister for Industry and Commerce may prescribe, of all operations in connection with the transfer of oil to and from that vessel.

Now, therefore, the Minister for Industry and Commerce in pursuance of the said Section 6 and of all other powers enabling him in that behalf hereby prescribes as follows :—

1. The record to be kept under the said Act shall be in such form as to show clearly the following particulars:

(i) The name and port of registry of the vessel or barge.

(ii) The date and time of transfer.

(iii) The place of transfer.

(iv) The amount and description of oil transferred.

(v) From what vessel, barge or premises on land, and to what vessel, barge or premises the oil was transferred.

2. The record of each operation shall be separately signed and dated by the owner of a barge or master of any other vessel as provided by Section 6 (2) of the said Act.

3. The record may be kept in the Official Log of a vessel, in which case the name and port of registry of the vessel need not be stated separately.

4. This Order may be cited as the Oil in Navigable Waters (Records) Order, 1926.

NOTE:This Act applies to any vessel which is capable of carrying in bulk, whether for cargo or for bunker purposes, more than twenty-five tons of oil at one time, or which though not so capable is constructed or fitted to carry in bulk as aforesaid more than five tons of oil in any one space or container.

The provisions of Section 6 (2) of the Act are as follows:—

"The record required by this section to be kept shall, in the case of a barge, be kept by the owner of the barge, and shall, in the case of any other vessel, be kept by the master of the vessel."
