COUNTY RATE (1926 TO 1927) AJUSTMENT RULES, 1926.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

LOCAL GOVERNMENT ACT, 1925 .

WHEREAS by paragraph (c) of sub-section (1) of section 86 of the Local Government Act, 1925 (in this Order referred to as " the Act "), the Minister for Local Government and Public Health (in this Order referred to as " the Minister ") is empowered to make rules for carrying the Act into effect and in particular for regulating (amongst other things) any adjustments of rights, duties or liabilities required for the purposes of the Act :

AND WHEREAS it is provided in effect by sub-section (5) of section 84 of the Act that if the amount of the rate raised and levied by the council of a county before the lst day of June, 1925, upon and in any area for the service of the local financial year ending on the 31st day of March, 1926, under the provisions of the said section 84 exceeds or is less than the amount of the rate which, save for the said section 84, would have been raised and levied upon and in such area for the service of the said local financial year under the Act, such excess or deficit is to be taken into account by way of adjustment in the rate to be raised and levied for the service of the local financial year ending on the 31st day of March, 1927 :

NOW THEREFORE I, the Minister, in exercise of the powers vested in me under the said paragraph (c) of sub-section (1) of section 86 of the Act, and of all other powers enabling me in that behalf for the purpose of regulating certain adjustments required as aforesaid do hereby make the following rules, that is to say :—

1. In these rules the expression " separate charge " has the same meaning as in the Public Bodies Order, 1925.

2. Wherever the amount of the rate raised and levied by the council of a county before the 1st day of June, 1925, under the provisions of section 84 of the Act, upon and in the area of any rural district existing in such county on the 30th day of September, 1925, for the service of the local financial year ending on the 31st day of March, 1926, exceeds or is less than the amount of the rate which, save for the said section 84, would have been raised and levied upon and in such area for the service of the said local financial year under the Act, the adjustment required by sub-section 5 of the said section shall be made by reducing or increasing (as the case may require) the rate to be raised in such area as a separate charge for the service of the local financial year ending on the 31st day of March, 1927.

3. This Order may be cited as the County Rate (1926 to 1927) Adjustment Rules, 1926.
