GÁRDA SÍOCHÁNA.

PROMOTION REGULATIONS MADE BY THE MINISTER FOR JUSTICE, WITH THE APPROVAL OF THE EXECUTIVE COUNCIL, UNDER SECTION 14 (1) OF THE POLICE FORCES AMALGAMATION ACT, 1925 .

By virtue of the powers conferred on me by Section 14 of the Police Forces Amalgamation Act, 1925 , and of all other powers enabling me in that behalf, I CAOIMHGHIN O H-UIGIN, Minister for Justice, with the approval of the Executive Council, do hereby make the following regulations:—

1. A Guard shall not be eligible for promotion to the rank of Sergeant unless he has passed, or unless he is exempted under these regulations from passing, an examination in educational subjects land an examination in police duties, which examinations are hereinafter referred to as the Class III. Promotion examinations.

2. The Class III Promotion examinations shall be conducted by means of written papers and/or oral examinations upon the following subjects:—

3. A Guard who passed the Class III literary examination for promotion in the Dublin, Metroprolitan Police shall be exempted from passing the Class III Promotion examination in educational subjects under these regulations, and if he also passed the examination in Police duties and drill for promotion to the rank of Sergeant in the Dublin Metropolitan Police he shall be exempted from passing the Class III. Promotion examination in Police duties under these regulations. A Guard who passed, or was deemed to have passed, the " P " examination under the Gárda Síochána Regulations (Promotion), 1924, shall be exempted from passing the Class III. Promotion examination in educational subjects under these regulations.

4. Promotion to the rank of Sergeant shall be by selection of eligible Guards but a proportion of vacancies may be reserved for competitive examinations confined to selected Guards who are eligible for promotion:

Provided that

(a) all vacancies in the rank of Sergeant in the Uniform Branch in the Dublin Metropolitan Area (excluding Headquarters and the Depot) shall be filled by the promotion of eligible Guards who have served for not less than three years in that Area; and

(b) all vacancies in the rank of Sergeant in the Uniform Branch outside the Dublin Metropolitan Area shall be filled by the promotion of eligible Guards who have served outside that Area, or at the Depot or Headquarters for two years or continuously since joining the Force.

5. A Sergeant shall not be eligible for promotion to the rank of Station Sergeant unless he has passed or unless he is exempted under these regulations from passing an examination in educational subjects and an examination in police duties, which examinations are hereinafter referred to as the Class II Promotion examinations.

6. The Class II Promotion examinations shall be conducted by means of written papers and/or oral examinations upon the following subjects:—

(a) Examination

in

Educational

subjects.

Dictation

Irish.

English Composition.

Precis.

Arithmetic.

Geography.

{

Handwriting.

Orthography.

(b) Examination

in

Police

Duties.

{

Criminal Law and Procedure.

Police and Detective Duties.

7. A Sergeant who has passed the Class II Literary examination for promotion in the Dublin Metropolitan Police shall be exempted—

(a) from passing the Class II Promotion examination in educational

subjects under these regulations; and

(b) from passing in Criminal Law and Procedure in the Class II Promotion examination in police duties under these regulations.

If he has also passed the examination in police duties and drill for promotion to the rank of Station Sergeant in the Dublin Metropolitan Police he shall be exempted from the Class II. Promotion examination in police duties under these regulations.

8. All vancancies in the rank of Station Sergeant in the Dublin Metropolitan Area shall be filled by promotion of eligible Sergeants who have served in that Area for not less than 5 years.

Promotion shall be by selection, but a proportion of vacancies may be reserved for competitive examination confined to selected Sergeants eligible for promotion.

9. A Sergeant or Station Sergeant shall not be eligible for promotion to the rank of Inspector unless he has passed or unless he is exempted under these regulations from passing an examination in educational subjects and an examination in police duties which examinations are hereinafter referred to as the Class I Promotion examinations.

10. The Class I Promotion examinations shall be conducted by means of written papers and/or oral examinations upon the following subjects:

(a) Examination

in

Educational

subjects.

{

Irish.

English Composition.

Arithmetic.

Geography.

(b) Examination

in

Police

Duties.

{

Criminal Law and Procedure.

Law of Evidence.

Police and Detective Duties.

General and Routine Orders.

Drill.

11. A Station Sergeant who has passed the Class I Literary examination for promotion in the Dublin Metropolitan Police shall be exempted

(a) from passing the Class I Promotion examination in educational subjects under these regulations, and

(b) from passing in Criminal Law and Procedure and the Law of Evidence in the Class I Promotion examination in police duties under these regulations.

If he has also passed the examination in police duties and drill for promotion to the rank of Inspector in the Dublin Metropolitan Police he shall be exempted from passing the Class I Promotion examination in police duties under these regulations.

A Sergeant who passed or was deemed to have passed the "P" examination under the Gárda Síochána Regulations (Promotion), 1924, shall be exempted from passing the Class I Promotion examination in educational subjects under these regulations.

12. Promotion to the rank of Inspector shall be by selection of eligible Sergeants or Station Sergeants but a proportion of vacancies may be reserved for competitive examination confined to selected Sergeants or Station Sergeants who are eligible for promotion:

Provided that

(a) all vacancies in the rank of Inspector in the Uniform Branch in the Dublin Metropolitan Area (excluding Headquarters and Depot) shall be filled by the promotion of eligible Station Sergeants serving in that area:and

(b) all vacancies in the rank of Inspector in the Uniform Branch outside the Dublin Metropolitan Area shall be filled by the promotion of eligible Sergeants serving outside that Area, or at Depot or Headquarters.

13. A member of the Force who has passed—

(a) any one of the following examinations, viz:—

Middle Grade or Intermediate Certificate, Intermediate Board;

Examination for Certificate for ex-officio Inspectors of Weights and Measures;

Any "P" examination previously held by Civil Service Commissioner;

Easter Scholarship Examination (Department of Education);

Any other examination authorised as an exempting examination by the Minister for Justice; and

(b) a qualifying examination in Irish

may be exempted from passing one or more Promotion examinations in educational subjects under these regulations: provided however that in any case where the examination at (a) included Irish and the member concerned passed in that subject he shall not be required to pass the qualifying examination at (b) in order to be entitled to exemption under this regulation.

14. In all the Promotion Examinations in educational subjects prescribed by these regulations Irish shall be an optional subject for those members of the Force who were serving in the Dublin Metropolitan Police prior to the 1st April, 1922, and for such other exceptional cases as the Minister for Justice may authorise.

15. Promotion to the rank of Superintendent shall be by selection of suitable Inspectors, but a proportion of vacancies may be reserved for competitive examination confined to selected Inspectors:

Provided that

(a) all vacancies in the rank of Superintendent in the Uniform Branch in the Dublin Metropolitan Area (excluding Headquarters and Depot) shall be filled by the promotion of men serving as Inspectors in that Area; and

(b) all vacancies in the rank of Superintendent in the Uniform Branch outside the Dublin Metropolitan Area shall be filled by the promotion of men serving as Inspectors outside that Area, or at the Depot or Headquarters.

16. All Superintendents appointed after the commencement of these Regulations, other than Superintendents appointed to fill vacancies in the Uniform Branch in the Dublin Metropolitan Area (excluding Headquarters and the Depot), shall be graded on first appointment as Third Grade Superintendents.

A Superintendent of the Third Grade shall not be eligible for promotion to the Second (Grade until he shall have completed three years service in the former Grade. For the purpose of this regulation service as an Inspector in the Gárda Síochána prior to the 1st April, 1925, if immediately followed by promotion to Superintendent rank shall be treated as service as a Third Grade Superintendent.

A Superintendent of the Second Grade shall not be eligible for promotion to the First (Trade until he shall have completed five years in the former Grade.

17. All Chief Superintendents appointed after the commencement of these Regulations shall be graded on First appointment as Second Grade Chief Superintendents.

A Chief Superintendent of the Second Grade shall not be eligible for promotion to the First Grade until he shall have completed at least three years service in the former Grade.

18. For the proper conduct of all examinations held under these Regulations (other than Promotion examinations in educational subjects which shall be conducted by the Civil Service Commissioners) an Examination Board shall be appointed by the Commissioner consisting of not less than three officers of the Force not being below the rank of Superintendent. Officers so appointed may from time to time be removed from the Board by the Commissioner and replaced by other officers similarly appointed.

The detailed syllabus for each such examination shall be prescribed by the Commissioner, subject to the approval of the Minister for Justice.

19. These Regulations shall come into operation on the first day of May, 1925, as from which date the Gárda Síochána Regulations (Promotion), 1924, and all existing orders and regulations made under Section 5 of the Dublin Police Act, 1836, relative to promotion in the Dublin Metropolitan Police shall be revoked.

20. These Regulations may for all purposes be cited as the Gárda Síochána (Promotion) Regulations, 1925.
